Timeline

What are the rules about flying outside the US when Fiance gets here on a K1 visa.

So once my fiance comes to the US, will we be able to fly outside the US, or take a cruise for our honeymoon. Will she be able to do this kind of stuff using her K1 visa, or should we wake until she gets a green card. Im not too familiar with the requirements.

I asked my Attorney the same question (regarding if my fiance can travel outside the U.S.) and was told NO, he cannot. It was further explained that if he did leave the U.S., for any reason, we would have to start the K-1 process all over again. Hope this information is helpful.

She will not be able to leave the US and then re-enter without either AP --Advanced Parole-- paperwork (which allows her to re-enter the US while she is waiting for her green card), or her green card in hand.

So you either have a honeymoon within the confines of the US, or wait until she has the proper paperwork.

She must apply for and receive a document called advance parole. It can take several months to receive.

Generally speaking, unless you significantly delay your honeymoon, she isn't going to be able to have it outside of the country.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

As far as I know on I-129F, it's one time entrance. Either you do your honeymoon in the states side just to be safe or wait till later on to do you HONEYMOON. I have a friend did that and now she have to go back to her country and refile paperwork and wait for approval again. It's ONE time entrance for I-129F.

right, but she can leave and return if they have her AP paperwork in hand. AP gives permission to leave and be re-admitted to the US while waiting for the green card application to be approved.

One does not have to have the honeymoon right after the wedding. :)

What happens if you have an emergency and HAVE TO fly back to your country? Is there a way to get an 'instant" Advance Parole at one of the immigration office?

Also, if you leave, can't you wait for the AP to come in and then go back in under that AP?

These are questions which have been bugging me for a while...

Our Timeline below - CA Service Center - Consulate: Rio de Janeiro - Local Office: San Jose, CA

October 5, 2006: We meet for the first time!

March 8, 2008: I-129F K1-Fiancee Visa Application mailed

October 27, 2008: K1 VISA RECEIVED !! (233 days - 7 MONTHS 19 DAYS)

January 17, 2009: Entry - POE: JFK w/EAD (315 days)

February 6, 2009: WEDDING! (335 days)

March 24, 2009: Sent AOS, EAD, AP package to Chicago Lock box (381 days - 1 YEAR 16 DAYS)

June 30, 2009: Interview in San Jose, CA (479 days) - NOT approved, Sworn statement required

AUGUST 14, 2009: GREEN CARD IN HAND (524 days - 1 YEAR 5 MONTHS 6 DAYS)

May 31, 2011: Sent I-751 Removal of Conditions package (1179 days - 3 YEARS 2 MONTHS 23 DAYS)

January 25, 2012: 10-Year Green Card Received (1418 days - 3 YEARS 10 MONTHS 17 DAYS)

Yes, you can have an AP in emergency. You'll need to prove the emergency. and it has to concern someone of your close family only.
