is there a way to get your missing noa2 without it costing $340?

I posted before that we never recieved our noa2

the only reason we know we are approved is the nvc letter, the call to Nvc who told us when it happened and my packet 3 on my doorstep. Online its still pending.

I know we need this for AOS

we waited till after 30 days to phone again about our copy of noa2 and were told to file form for second copy and book an appointment with our local office. This will cost us $340!!!

Is there a way for us not to have to pay that much for it?

I would understand if we lost it ourselves but I have doubts they even posted it to us?

Only way is if NOA2 was Returned to USCIS as undeliverable, they may issue another because they have proof that first one was "Never Received" by petitioner, but this typically only applies to green-cards returned as undeliverable.

I always wonder why it is needed for AOS, you send a photo copy of K-1 visa which shows petitioner and beneficiary on it. AOS is based on the K-1.

Unfortunately I-485 instructions say:

15. Evidence of eligibility.

B. Based on admission as the K-1 fiancé(e) of a U. S. citizen and subsequent marriage to that citizen.

Attach a copy of the fiancé(e) petition approval notice, a copy of your marriage certificate, and your Form 1-94.

Technically, they can probably make you pay it. However, you can often get out of it if you call the USCIS and press the buttons for RFE. you will get connected to the actual service center, not just the stupid call center. Explain the problem and often times they will just reissued the NOA2 for free. Give it a try before you pay them 340$ When I called, the lady even called me back 2 weeks later to make sure we got it!

I could not find my NOA2 at one point. They will issue you another copy for free was my understanding. I thought there was an option to request a copy of your NOA2. That was a while ago though.

If you did nto get a copy at all, they should send you a new one without charge. Chit happens.

Try making an infopass appointment. I never received my NOA2 but went to infopass and they resent it for free. I was getting the returned as undeliverable message. Good luck.

Not for USCIS apparently. If it wasn't returned as undeliverable they will hassle you about needing to pay for a copy. The only way to get around that is to get through to the actual service center or it looks like someone had luck with an infopass appt.
