My fiance just arrived last week from Cuba on a K1 visa and according to the flowchart on this website, we can apply for his social security card before we actually marry. Before we head down to the DMV and wait forever, can anyone confirm if we need to wait until we get married in order for him to apply? Thanks for any help you can offer on this.

7 day will be good on Social Security Card, quck and easy.

DMV - I can't get Texas to give my wife a State ID or Learning Permit to drive until after she finishes AOS.

That is worrying to hear as I will be moving to Texas, so that will be years before I am allowed to drive, now I am freaking out, how am I supposed to work, shop, or get around when I get to Texas there must be a way around this, they cant expect you to not be able to get around when there is no public transport. If you dont mind me asking where abouts are you in Texas

Firstly you don't apply for an SSN at the DMV, you need to go to SSA office for SSN.

NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

Most states require proof of residence before issuing learner's permit of driver's license, usually EAD card or Green-Card is needed.

This statement popped out at me. Does that mean that we may not be able to wed until her SSN has been issued/SS card has arrived?

I was hoping on having the wedding almost immediately subsequent to her arrival. I do recall several posters saying that the SS card usually arrives quickly after applying, but should we be factoring an extra week or so after her arrival for the wedding?

On the application for the jurisdiction where we intend to marry, it does ask for both parties SSN as well as nationality. There is no indication whether this is mandatory or not, so perhaps a phone call can clear all that up.

Were in Colorado and tried to get joan a state ID card, they made us fill out this S.A.V.E information, it will be sent in to home land security to check, they said if all is well she can get in 3 weeks sometimes it takes 9 weeks, she can not get a checking account or anything, even though she has a S.S card, were just trying to gather all the evidence we can for proof of relationship. good luck :unsure:

Not a problem MOST states will issue a Marriage license to persons that do not have SSN.

Re Texas, this is what has happened so far:

1. Marriage license procured with no problem (Fort Bend County). County clerk says that DPS (Driver's License agency) will accept her passport (who she was) and marriage certificate (who she is) as enough to issue her a Texas state I.D. (which we haven't tried to procure yet -- married just on Friday).

2. Can't add her as joint on my checking account without a Texas state I.D.

Haven't applied for SSN yet; don't know if this will be needed for a Texas state I.D.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm going through the same process now....

He can get his SS# before you get married, but he cant get a drivers licenses until he gets his SS#.

In the US, many things are determined by the State government, not the United States Federal government. Social Security is US and the rules are the same to all of us. But marriage, driving, schools, insurance, some banks follow rules set by the state. Just wanted to point that out because what works in California, may not work in Texas or Louisiana. It's best to consult your particular state government webpages to find out the rules you will have to follow. In Texas, the marriage license was given just by showing foreign passport. A bank account was opened with only the passport , but that seems to vary widely branch to branch. The Social Security card was ordered 11 days after POE. But the Texas driver's license may be a little harder because they made new rules that went into effect Oct 1, 2008.
