Request for Expedited Processing I-130

I am writing to ask if anyone can give me more information about requesting to have a K-3 visa application expedited under the heading of financial loss to an individual.

I don't think that I qualify but I thought I would see if other people who have applied could help me out a bit. My situation is that I am currently residing with my husband abroad but I have been offered a good job to start in January in the U.S. If I do not take the job and instead stay with my husband here, I am loosing that potential income. On the other hand, if I take the job and am separated from my husband I have to think about financially running two households as well as the price of communication. I know that many people are separated, and many people run two households and I respect all of you for that. My question is does anyone have any experience with a similar circumstance and was either granted or denied the request to expedite.

Does anyone know what documents I might need in order to apply for expedited processing?

My understanding of what they consider to approve for financial hardship is if without his income you would end up being homeless or something like that... The loss of a job is not going to fly with them. I also asked about going that route. That's what they told me they would consider. Only situations of life and death.

Well. Your case is different.Let me tell u first abt my expidition experience my wife is very sick she wanted me to come to US quickly she got the letter from her doctor in which the doctor adressed to the USCIS regarding her health and they handled our case fastly.

In your case you have financial crises i dont want to let u down but i dont think so that they will approve ur request coz there r only 2 things in which they give thier attention.

1-Health matter

2-Security issues

So just try it.For this you will have to write a letter for USCIS and explain ur problems may be they will accept it.

One month ago we requested expedite processing based on financial hardship at VSC. We never got an answer (not even a NO). So... I think it only works for military and life or death issues. But if you wanna try, it won't hurt.

Our Immigration Timeline:

Form I-130 sent to Chicago - 03/18/08 (Case in VSC)

NOA 1 - 03/26/08

Updates - 04/01/08; 06/16/08; 06/17/08

NOA 2 - 01/23/09

NVC received papers - 01/30/09

NVC generated DS 3032 and AOS bill - 02/02/09

DS 3032 sent by e-mail and snail mail - 02/02/09

NVC replied my e-mail confirming my choice of agent - 02/06/09

AOS bill received - 02/07/09

AOS bill and IV bill paid online - 02/07/09

AOS and IV display the PAID message - 02/11/09

AOS and DS-230 packages sent - 02/11/09

NVC received packages - 02/13/09

NVC sent RFE (mistake on DS-230) - 02/20/09

Form DS-230 re-sent (as requested) - 02/26/09

CASE COMPLETE - 03/05/09

You can always try, but remember, that for every expedite, people get pushed further back in line that have been waiting longer, so they don't hand them out generously. It also takes time to deal with expedite requests. Yes, it cost my kids more to live on different continents and wait for months in limbo because she couldn't be here. It's been hard and they've both had to make some sacrifices, but it hasn't killed them. I think they've actually talked more than if they had been together, which is a good thing. There are some really good phone rates for Thailand.

If I'm correct, you filed with the California Service Center, they're moving pretty quickly, I'd take the job (especially if it pays well, I don't know how easy it would be to get another job at this time/when you do return to the U.S.) and request for an expedite. You might not get the expedite but if you don't, it'll only be a few months away from your spouse, the CSC works pretty quickly compaired to some of the other Service Centers.

Trust me, I'm going through the whole supporting 2 households on one income, it's difficult, but it's manageable. USCIS doesn't really work too well with expediting from my experience. But your expedite request may run smoother and you may get an approval. My reason for expediting was due to the border clashes between Thailand and Cambodia being in the same area as my wife and step-daughter, the financial problems it (trying to support 2 households on my income) is creating for us, the political unrest, and the milk from China being delivered to Thailand, all this I have to worry about along with taking care of my airmen (including those deploying and coming back from deployments). I think there was a mix up somewhere but they denied my step-daughter's expedite request, they incorrectly filled out my wife's expedite request, and still waiting to hear back about the expedite on the K3/K4 visas, but I'm trying to give it time.

Anyways, as far as documents, you'd need to provide the letter/documentation about the job stating you were offered the job, I'd get information regarding the cost of living in the area where the job is along with the cost of living for where your husband is/will be living while you will be working the job, bank statements (I'd have them on standby just in case, you only have 20 days to get supporting documents to whatever office is reviewing your case). I'd try to create some type of spreadsheet showing your finances and your husbands finances things like rent/house note, projected utilities, projected cost of food for the month, I'd flood them with everything I could, you rather have more information than not enough.

I'd be more concerned about you having domicile in the US. Also you being financially able to support your husband.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thank you everyone for your replies. This information is extremely helpful. For now I will not apply for the expedite, and it seems that there is probably slim chances that even if I did it would be approved but perhaps it doesn't cost anything to try. However, for now I will hope that CSC moves along and we receive the approval in line just like everyone else before I start the job.

jurod16- thanks so much for advising what paperwork to prepare. I have started gathering these things just in case.

Haole- As far as domicile, I am not too worried I maintain a U.S. address, bank accounts, driver's license, even jury duty. And for financially supporting my spouse, we have co-sponsors to prove to the USCIS that I will in fact be able to support him.

Thai Mom- thanks for the encouragement. We have spent a considerable part of our relationship apart but under different circumstance than what exist now. We both know the difficulties and know we can survive but hope that we don't have to do it again, if possible. Where did you find good phone rates to Thailand?
