I got a letter from my congressman this past week, which was somewhat confusing... Following is the letter in it's entirety.

House of Representatives

Washington, DC 20515-4201

October 22, 2008

Dear Mr. ________:

In response to my recent inquiry in your behalf, my office has been advised by the Citizenship and Immigration Service that their records indicate your I-130 application was received on March 20, 2008, and the Service is currently processing petitions in this category received on or before November 26, 2007. With regard to the I-129F application, it was received by the Service on April 7, 2008 and they are currently processing petitions in this category received on or before February 1, 2008.

According to the Vermont Service Center the petitions will be processed simultaneously and the earlier priority date will determine the processing time frame. In this instance, the February 1, 2008 date will be used as the processing date.

I hope this information is helpful and I appreciate this opportunity to have been of assistance.

So, one thing that is confusing is that I think they actually are processing more recent ones right now. Secondly, when they say "earlier priority date", and that link that statement to when my I-129F was received, I actually think the person who wrote that meant the more RECENT priority date, because they tied that to February 1, 2008, not November 26, 2007.

At any rate, the letter was confusing, and I still have no real idea what is going on. I am posting the letter here, in case anyone else cares to comment, input their views, or compare to what they have been told.

Why are you contacting that office if you have your NOA1's & Priority dates? Anyhow, looks reasonably straight forward to me despite the words simultaneously and earlier priority date etc. The information is fairly meaningless as the I-129 could slow down and the I-130 speed up.

It's at least a couple of months too soon to be asking for a congressman's help. Their aides simply log into an online system at the USCIS and get an automated response to their inquiry. In fact, you're about on schedule, it seems.

LOL.. I contacted the congressman because like everyone else I am trying to find out what the big holdup is at VSC. Several others are trying to find out the same and also contacting their representatives. I simply shared what the response was that I got from my congressman. You see, in case you have not noticed, at VSC everything is going at a snails pace, and many of us are wondering why the big holdup and wondering where our petitions are at in the middle of it all, and trying to figure out how to get them moving.

Personally, I think you did the right thing by contacting your congressperson. I would give it two weeks and do it again. next time I would explain how the present economy along with the slowdown at VSC is forcing you to make choices. whether to support your familiy in two places or pay your mortgage. therefore causing you severe financial loss. setting you up for an expedite if needed. nothing ventured, nothing gained.

So why does their processing time table say that they're processing February 2008 petitions??? They are so full of SHI* I can't stand these people! They lie, lie, lie... some people have their stuff done in 5 months and others in 3 years...there is no rhyme or reason. I used to think it's due to the country, but that's not the case. I have now seen cases from Pakistan, Morocco, Phillipines be processed in a couple of months and others taking years, under the guise of "security clearance"... I'm finished with trying to figure out when they'll approve petitions. I think they just play lottery with them and if you're lucky, your number gets picked...

I got that same type of response and immediately sent another request for a more detailed response. I just faxed another letter thanking them for their work, but that i wanted to know WHAT was holding up our petition.

I received another response saying that there has been activity but it was all routine and that our case has yet to be sent to or reviewed by an adjudicator. Not good news, but at least i knew it wasnt being held up in background checks or whatever. I get to make the "outside normal processing times" call on the 7th! yippee heh hee

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.
