K1 does my son need his own visa?

Children Have Derivative Status

The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is long than one year from the date of visa issuance, a separate immigrant visa petition is required.

Remember that in immigration law a child must be unmarried. The stepparent/stepchild relationship must be created before the child reaches the age of 18.

Ok I am a little confused. We are doing the K-1. And now I hear from people that my son needs a visa of his own. He is 5 years old and my fiance (the US citizen) putted him on the !-129F.

Who can clear things up for me. Cause I want him to go with me when I move.

If your son has his own passport he will have the K2 put in that - if not, it goes in yours. There will more forms to fill in at packet 3 stage on his behalf and he will need to have a medical - but the kids medical is very non-invasive (no x-ray, no blood drawn). Depending on your consulate he may not need to attend interview - the one in UK doesn't require kids under 14 to attend (though you can take them if you so wish).

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

No, children listed on I-129f will not automatically get visas. They have to apply for a visa (and pay the fee) to get a visa - if they want one.

When you fill out your I-129F you need to list all children you have. They will automatically get their visa when you get yours.

Hi Cristy, not fair it goes so much fatser for you. even thought the papers got sended in only 7 days in between.

Ok so that shows it self then at the consulate. I guess I need to bring Nathan with me when I go there and Andrew doesnt have to aply for a visa for him.
