Hi

I just have a quick question. I am a US citizen who got married to a South African with one child (15 year old) already in the US. I need to apply for her to adjust status. Do I apply for I-130 and I-485 for both of them? Do I even need to apply for I-130?

Anybody know?

Yes, you need an I-130 for each and I-485 for each.

it depends on how did she originally entered the county, if legally then yes and if not then she can't adjust status while in the u.s

Pretty tough for South Africans to enter the US illegally. It's not like they can swim a river or climb a wall. :thumbs:

loool loool well i know ppl who came thru mexico and they were not mexicans , or even canada but that was funny anyway lol
