Hello all,

I am wondering about the domicile requirements for the US citizen. I gave up my apartment when i came to the Philippines to be with my wife while working her visa. I have reported on every immigration extension since i have been here that i was here working her visa and have been under an extended visitor visa. I have been here since September of 2007 and have been using my sister's address in the states as my state side address. I have maintained my bank account in the states and am receiving SS and a pension from General Motors. Is this sufficient to maintain my domicile status? Thanks

yes i am filling taxes and my current drivers license doesn't expire till may of 2009

then it appears you have not done anything to "give up" domicile.

we are just worried because some says that i need to go back to the states to re-establish my domicile which is a financial strain, and if its not necessary i will just wait till my wife visa done.

Prior to the interview, I had been living in the Philippines. We went to the interview with my current Texas driver's license showing my son's address. I also had two different bank accounts with that address.

We were turned down because of not enough proof of US domicile. They wanted utilities receipts for that address in my name, a rental aggrement for that address in my name or proof of home ownership.

I returned to the States and rented an apartment with the utilities in my name. I sent copies along with pics of me being in the States. Hopefully, her visa will be approved soon.

It was a hardship for us, but I will do whatever is necessary for her to come to the States and get married.

hello, we're discussing right now with my husband having him back earlier in the states to fix the domicile issues and to set up things there for us, (like renting an apartment, set up our utilities there such as electric, telephone and etc.) we are planning that base on our visa time frame that I might have my interview by early May or later or earlier than that, so for this, we are planning to let my husband go back to the states by March so he can set up and sent those documents with me here in Philippines and have it present to the CO during my interview. And our other options will ask my husband son to set up an apartment for us in my husband's name and let him sent the documents here in the Philippines for us to present to the CO during my interview. Is this second options will meet the domicile issues?

Another thing during my CR1 application as our states side address we're using my sister in-law address which is in Michigan and to fix my husband domicile issues we are planning to set up an apartment located at Mississippi area, would it be create additional problem since we are using my sister in-law address on a application we have.

i been in the Philippines for 3 years ..since 2005. i went back to US year 2007 and filed a petition for my husband. October 27, 2007 after 4 month i went back to the Philippines while I'm waiting for my husband visa approval.

my husband interview date was Sept 29 2008 and i prepared all my documents for my domicile. guess what.????.. they didn't event ask for it.

this is what i brought for my husband interview just in case they ask my domicile

bank statement

voters registration.

land line phone bills.

pre paid cell phone bill.

driver license

and some junk mails shows my address.

but the Co's didn't ask any of it.

good luck guys. i think its depends on Co's good luck guys

If you are rec'v SS and a pension from GM.

You are kinda live my dream for the future. Make your money in US and live in PI.

If it were me I would stay in PI and make an occasional visit about every 5 years to USA.
