Hello, this is my first post here, me and my fiancee (she lives in the USA) are not applying just yet, Othen then having to wait for her divorce to be finished, we've also decided to learn as much as possible about this wonderful process we have to go through befor applying. So here is the first of many question, that we will probably have. Does having joint custody (they have already decided to do joint custody) effect the amount of support she has to make? The joint custody they are going for is weekly, one week with her, one with him.

Good luck to all those going through this, and thanks for all your help.

Adam

More than likely there will (or should) be some agreement as far as claiming the child as a Dependant on his/her taxes (often times it's every other year) - unless there is some financial arrangement made as part of the divorce.

Even so, it may be safe to assume the child as a Dependant and calculate your household as 3 (you, your wife and child). It comes out to $22,000/year vs $17,000/year (with household of 2), a little more if you plan to live in Hawaii or Alaska.

Hello again, I forgot to mention that she will be getting child support and alimony payments, can these payments be used as support?

I worded the last question wrong. My mistake, what I ment was does the amount of time the kids spent in the home have any bearing on the amount of income that has to be made to be considered sufficient support?

Thanks again, Adam

Court ordered child support can be counted but if it is, then yes, the kids are counted as dependants, when calculating household size on the affidavit of support. Depending on the term of alimony, that may also count as income.

Facts are cheap...knowing how to use them is precious...
