Hello! I'm new here and wanted to ask a couple of questions I'm confused about.

My husband is a VWP overstayer and I am a USC. We were married in late June...less than a month AFTER his I-94 expired. (he never had any intent to stay, just to clarify) We want to apply for AOS as I've been promoted at my job to full time (after 3 years here! WHOOO!) and now have the income to do it.

Here are my questions!

1. Some places say I only need to file an I-485 some say both I-485 AND I-130. Help! Do I file both and at the same time, or for a VWP overstayer is it just one of them? I'm a bit confused!

2. I have been previously married and my previous tax forms from last year have my ex husband's name on it, plus I didn't make enough then anyway. (I make enough now and have the paycheck stubs to prove it) Do I not need to submit a tax form at all and can I just send in a letter from my employer with my hours, pay stubs, etc.? Or do they still need my tax form with the ex's name on it or would the letter and stubs from the employer be sufficient?

3. Concerning the form of financial support...We rent a room with roommates in which I pay them rent. Do I need to include my 2 housemates in our household? I wouldn't so as we just rent a room but didn't know?

4. I was married 2 times before. Do they frown down upon that? (especially as I"m only 27 yrs old...) I know I have to provide forms proving I was divorced but didn't know if anyone else who had been married more than once in the past had any trouble with that.

Thank you so much! :) I'll try to reread the I-864 a bit more carefully. (It's a bit overwhelming at first, I admit but I'm getting the hang of it!)
