If you have a parent who married a United States Citizen (Step-parent petition):

You may be eligible to have your Step-parent file a Visa Petition on your behalf. In order to qualify, your Step-parent must have married your natural parent (mother or father) before your 18th birthday. Therefore, in order for your Step-parent to file a Visa Petition on your behalf, you must be considered a child of your natural parent as defined above.

According to what the internet says, if they were married after you were 18 then your step mother cannot petition for you. But since your father is an LPR then he can petition for you, but it will take a very long time. The site said 8-12 years.

Did she marry your father before your 18h birthday?

If yes, then she can petition for you.

If no, you have to wait until your father becomes a USC and then he can file for you.

Ok, I understood, should we file the petitions on LPR or we have to wait for father USC?....

If petitions files on LPR and after 3 years father will get USC then after petitions upgrade ..... USCIS will consider the previous time frame?????

i think, my question is little bit confusing :)

but on LPR, it will take long time, while after 3 years my father will get USC.....if then he submit the petitions then I think it will take short time.....

Yes, they should keep your orignal priority date on the case. I am sure about spouse petitions and I assume that child application would be the same.

If I were in your position, I would have the DAD to apply as LPR and wait till he becomes a USC and then upgrade the petition.

MAke sure you read all the regulations on USCIS website about age and conditins.
