Unfortunately, we got our very first RFE on the I-485. They must have lost some of our papers (the W-2s)because it is stuff that we sent in our original package.

Anyway, what i am most confused about is that on the sheet it says "you are ineligible for interim employment authorization pursuant to Title 8, Code blah blah blah... until 90 days after the missing intial evidence is received."

This RFE is for his AOS, so why is the EAD also being delayed?? or am i misunderstanding something?

What they asked for (again!) has already been sent out, the same day we got it, but i am a bit annoyed that our EAD process is going to be slowed down for 3 months because of their own mistake!!

join the club...I believe the EAD is contigent upon appropriately filing for AOS. Unless your I-485 is completed, your EAD will be held up. I don't think it will be a full 90 days however since preliminary processing on your case has probably already been done (I lifted that last sentence from the email we received after we sent back our RFE docs) good luck ;)

Well, I was worried too when I got my RFE but in my case they

processed the EAD separately, I got it after 9 weeks of waiting...

October 30, 2005 - Married in Vegas

December 27, 2005 - EAD, AP, AOS mailed

January 4, 2006 - received in Chicago

January 27, 2006 - RFE for medical received

February 13, 2006 - Medical received

February 15, 2006 - Biometrics appointment at 10 am

March 1, 2006 - AP touched

March 4, 2006 - AP received

March 8, 2006 - EAD received

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Feb 28, 2008 - will be sending removal of conditions docs.
