Hello everyone!

I have a huge problem and I need an advice guys!

I am married to US citizen since July 2008. We were very good friends..kinda in love..he didnt want me to go back home so we decided to get marry!

At this time we didnt live together cuz he was supposed to move to my city! After a month he stopped talking to me... and now we talk once a week but its kinda weird! We thought that we can make something of nothing...didnt work out! In October I had to go back to my home country. He was supposed to help me to come back and work it out..try all over again..he filled out I- 130 to apply for CR1 visa. I called him yesterday..and actually we talked about..divorce..he thought that the whole process will take less than a year..he got upset and he confessed that he has a new girl...they are planning to settle down soon. I asked him why he was still trying to act like a real husband and file the petition for me..i heard just to help me to come back and live in California beacuse I loved it so much!!! I dont know what to think about it :( Does it matter whose fault it's going to be? He told me that he can take the blame on him so I wont have any problems later on. Can I divorce him without being in the US?

Yes, and depending on the laws, you can either get divorced in the state of his residence or in your home country....

Yes, and depending on the laws, you can either get divorced in the state of his residence or in your home country....

Yes, you can but this is a family court issue, not one of immigration. Without a bona fide marriage, you won't be getting any CR1 visa.

The above statement really makes your goals unclear.

Are you trying to:

a. Divorce your current husband?

b. Find someone else that you truly want to be married with?

c. Marry any US citizen for citizenship?

d. Use any US citizen for citizenship?

Based on your previous relationship, and your most recent statement, it appears that you are moving toward Immigration Fraud.

That is NOT what Visa Journey or its members are about, and violates the Terms of Service.

1) no, in a no contest divorce presence is typically not required (but ultimately that depends on the specific family laws of the state that the proceedings occur in)

2) I suppose, should you be able to find another USC and you are able to get another petition/visa approved.....

I think my questions are quite valid given the circumstances.

I understand that she is trying to find out what will happen to her.

However, in that she does not have a bona fide marriage, any attempts to proceed would be Visa Fraud.

Fraudulent immigration and marriage has absolutely no place on Visa Journey.

It is against the TOS, and it mocks each of us that awaits visas based on bona fide marriage.

If her primary goal is divorce, she should look for a divorce forum.

i understand but my marriage fell apart..it wasnt my goal but my husbands choice!

I am trying to find out if after our divorce i wont have any problems with getting married again beacuse i had a husband before and if it will be US citizen again are they going to try to ban me for visa or something like that! I can live in Europe but maybe my not my future partner

i think this is not fair of you saying that! my marriage is about to end..but my life goes on..

well..i think you shouldnt! i am assuming he didnt file for you any petition right? he just filled it out and thats it. without sending!

i am not a lawyer but for me you didnt get anything from the US govenment..it just didnt work out.

it happens..you are not the only one! keep your head up.

maybe it would be good idea if he could take the blame on him..if he offered you that!

looks like he just wants to get out if it...but you are not stopping him either.

however :) we shouldnt discuss about this :) this is your personal stuff and i respect that!

I'm only basing my analysis on what YOU have told us.

Bottom line, based on what you've told us in your initial post, you do not have a bona fide marriage.

If you proceed with immigration based on a non bona fide marriage, and are caught, you could be banned from the US for life.

My point is, immigration and family status are two different things. If you're truly concerned about your marriage/divorce then you should focus on THAT.

To come here asking about immigration based on this or a future marriage with a US citizen, makes you sound in-genuine.

To come here asking about immigration based on a non bona fide marriage, violates the TOS.

From what I understand, you were good friends and "kinda in love" but didn't want to leave the US, so you got married in July. Then things weren't working out, so you moved back home and he told you that although you two were getting a divorce and he wasn't interested in maintaining your marriage, he would file for a visa so that you could come back to California to live.

If that's correct, you won't get very far by not having a bonafide marriage.

Yes, you can divorce him without being in the US.

I can't help but see something negative in your posts when your question is:

Why are you concerned about this? You're not even divorced yet and already you're asking about marriage with another American. That doesn't usually happen by chance. If your sole interest is to come to the US again to live legally, you should look into work visas or something other than looking for a US citizen to marry.

Please don't marry a United States citizen just to get a green card. There are SO many of us here who are crazy in love with their spouses and separated for long periods of time and suffering. If I was behind you in line for my I-130 and you were not in a bonafide marriage, I would be grealty upset.

Marry for love, not a green card. Like Gemmie said, maybe you should start looking at other avenues and not just marrying a USC. I am sorry your marriage failed but it sounds like it wasn't much of a marriage to begin with.
