(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

"Give me your tired, your poor, your huddled masses yearning to breathe free, the wretched refuse of your teeming shore. Send these, the homeless, tempest-tost to me, I lift my lamp beside the golden door!"

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Welcome to the USA!!!

I am not sure about Thailand, but other countries of what I have heard, one signs DS-230 part 2 at the consulate, when you go for your interview, the first pre-screener, presents the applicant with DS-230 (part 2) and then they sign it.

You have to submit DS-230 both parts to NVC, just that PART1 will be signed and PART2 will be unsigned. Do check with NVC website and make sure you clarify thigns with your lawyer.

Does the NVC instructions give any guidance to the contrary?

Sorry...your lawyer is incompetent.

The beneficiary only signs DS-230 pt 1 before sending.

It clearly states on the DS-230 pt 2 "DO NOT SIGN this form until instructed to do so by a consular officer".

This is a way lawyers bad information can slow down your case while it empties your wallet.

Thanks man. My wallet is empty. I just cant believe this guy has no clue. It just keeps going on and on. NVC sent the docs on Oct. 16. I guess they don't check their mail.

My lawyer wasn't sure about that either. He sent two copies of page 4, one signed and one unsigned and just wrote on the letter that their request was unclear. I am sure that page 4 is unsigned.

I would call the NVC to clarify for your embassy. Make sure that your spouse keeps an unsigned copy to for safekeeping and to bring to embassy.

DS-230 pt 2 is a "Sworn Statement" that must be witnessed by a consular officer.

It's not country or embassy specific. It's a general requirement.

That is, there is only one DS-230 form, and the instructions for pt 2 are quite clear and specific.

Of course pt 1 is specific, but NOT clear. See the wiki or search for RFEs related to DS-230
