Forgive me if I'm wrong but if she doesn't petition for the I130 (i forget what form you do that with) then the K-3 won't just magically turn into the IR1. It's the CR1 via the I130 that turns into the IR1 if youve been married 2 years. I personally would go with the CR1. You don't want a flimsy K3 after this horrific nightmare. My husband is on a K3 and still has to pay another $1,100 eventually to get his greencard. Luckily we have another year to do that but time is ticking. Easier if you just git r done now and have the IR1 to show for your troubles. Then I believe you're done for ten years!

When we were going through this we had mailed in the I-130 and the I-129f since we heard that it was faster to get the K-3. At that time they would continue to process both of these, so if the I-130 and the I-129f was sent to the consulate at the same time they would cancel the I-129f and go with the I-130. So you are correct, the I-129f that gives you a K-3 will not be switched to the IR1, but the I-130 that gives you a CR1 will change. But I have heard that they now hold the I-130 if the I-129f is processing. I think that is stupid.

So Olivia, do you have a timeline to follow after the NVC completes the papers for the I-130 until the interview is scheduled? From what you have told me, that is the only difference from anyone elses petition with a similar process, such as Morocco. I think it would add an additional 3 months to the process.

Of course when we were going through it that 3 months sounded like an eternity, and yes there are fees. I believe that after he gets here on a K-3 he would need to adjust status within a specific timeframe, but I couldn't tell you what that fee is. Then he will receive the CR1 that is valid for 2 years. At the 2 year mark you would have to lift conditions, but again I am unsure of the fee for that.

So the benefits to the K-3 are that there is less money up front, and he will get here a few months sooner. The downfall is the extra processing once he gets here, and the time involved before he can work. You will still need to come up with bucks, and I believe in the end it is more. You will also need to prove your marriage is valid yet again.

The benefits to the IR1 is that he can work shortly upon arrival, and you will never need to prove your marriage again. No more money is needed until you are ready to apply for citizenship. The downfall is the extra dollars now rather than later, and the processing adds a few months.

I am glad that my husband came on IR1 (was suppose to be). He could work right after he got his SS#, so less time to be bored and lost. I NEVER have to prove my marriage is valid again. After what we went through this is probably my biggest reason that I have. We only have one more time to deal with them.

Thx! That is helpful. Both the I-130 and I-129 were approved at the USCIS Dec. 14th, 2007. The I-130 is just sitting at the USCIS until I request it to go on to the NVC. If they automatically change it then I need to explain this to my Husband anyways.

I also need to know what fees we're going to face going into this. I know it's larger fees for CR-1/IR-1 up front. I have read that the NVC now schedules the interview for Egypt since Feb. this year.

Yes NVC scheduales the interviews. U will pay $70 and then $400 and omg i cant remember for what :blink: !!! the immigration bill is the $400......the $70 i cant remember for what now but u do pay that! thats the total so far with NVC.

Ok so I need to pay the NVC at least $470 for the interview processing fees. Does that include the fee it may cost to request the I-130 be moved from the USCIS to the NVC? I think there was a fee for that too.

having a green card will also increase his chances of getting into a residency program. some of them require it.

Yes I told him that last night. That taking his USMLE's there and getting a high score along with having his IR-1 would make him look more employable. We could move where ever he got a job in his residency when we came back.

Wow ok. I think I need to find out the facts for certain of what all the fees will be. I'm thinking it take $350 to move the I-130 to the NVC now, and then there is the interview fees which total $470. I hope there are not anymore fees than that. Still that's $800+ rather than the adjustment fee of $1010 later when he comes.

Right, they started doing that when I filed and got approved so I was stuck with the same question, do I pay the extra $350 to move the I130 from Vermont to NVC or just hold my breath and wait for him to get the K-3. In our case the K-3 hasn't presented any problems yet. We paid for just the EAD instead of doing the whole Adjustment of STatus. It was much cheaper though of course now I forget how much it cost. Didn't take long at all for him to be able to work though. I think from the time he arrived to when he started working was less than 3 months total and ended up being just right since that's around how long it took him to be acclamated with living here, though he's still adjusting.

When we do file AOS we will have been married for 2 years so it will be the IR1 that he'll get and we won't have to do much else for 10 years I believe.

If u re doing IR1; there is no adjustment fee. Its for the k3.

After u send in ur I-130 and gets a approved this chart tells u what takes place at NVC:

the $70 is Affadavit of Support bill and the $400 is the Immigration Visa bill. Thats all u pay. Then the spouse later pays for the medical and DHL at the day of interview; thats it.

So what I need to do is call USCIS and formally request to process the already approved I-130 by sending it on to the NVC. At the same time send an email to the Consulate and tell them I am canceling the K3 visa and going with the CR-1/IR-1.

There is no extra fee for this?

The only fees I need to worry about now is the $400 interview fee, and the $70 Affidavit of Support bill. That I pay to the NVC now since they schedule our interview with the embassy?

Speaking of DCF - I have a friend who moves to Morocco to be with her husband. They inteneded on living there and not coming to the US. She got pregnant and then they decided to come back. Becasue she was living in Morocco she was able to file there. She had absolutley no trouble getting the visa for her husband. They applied and they had it in about 1 1/2 months. Given the way both of the countries are im assuming that Egypt will be able the same. Your already going there this summer for a few months. Stay a little longer and file there.

I was living with Wael and still had to wait. We did a DCF also. There are a few people here

who did DCF from Egypt ( living together) and waited longer than us. I think it is just at the whim of the country when one receives their visa. Perhaps other countries are faster than Egypt, but don't assume coz you live there you will get it faster! We have some friends who are also from Alexandria, married next month for 3 yrs, living together for 3 yrs and she is STILL waiting for his visa. But one can only hope!
