Bah! My Husband and I are at each others throats over switching from the K3 to the IR1.

He wants to see time lines to know the exact amount of time it would take us if we switched to the IR1.

I looked at the Immigration Timelines in the last 360 days for Egypt and it says 6 people applied for the CR-1/IR-1 with 4 having completed the interview and getting the visa and 2 still pending. The average number of days it took was 240 from submitting the application to receiving the visa.

This information isn't good enough for him so he's asking me to get a copy of these timelines so he can see the dates of processing himself.

I need to know who here is one of those 6 people from Egypt in the last 360 days being or has been processed on the CR-1/IR-1.

I need a copy of your timeline for him while he's sitting in the military camp so he can look at it on his mobile.

Thx!

Awesome I got one pm for one of those Egyptian CR-1's pending. Five more to go. Anyone have any idea who they are?

:crying: I really don't want to sift through 20 pages of Egyptian profiles to look at timelines.

We'll be married 2 yrs. this Dec. 28th.

I've read that before but I don't have any validation on that. Which begs the question if it is true then what happens to our wait time and interview fees?

What did you get an RFE for?

Does he understand the amount of work and money that you 2 will have to go through if he goes for the K-3 rather than the IR1? Where is his I-130 petition now?

It's at the USCIS. The I-129F is on hold at the Embassy until his release from the military next April. DOS already told us that the hold is certain as we have up to a year from it's arrival there. Which means that in April when it arrived there it will expire. DOS also told me that I can cancel the K3 at the Embassy and let them know we're pursuing the IR-1 after out 2 year anniversary this DEC. Then we have to send a letter of request to USCIS to transfer the I-130 go NVC. The I-130 has just been sitting at the USCIS waiting on the I-129F. Unusal case I know. Some have claimed that the I-130 will automatically be considered for the IR-1 after our two year anniversary. So it doesn't matter if we switch from the K3 ourselves or not. I don't know if that is really true not who to validate that with. If our K3 which we filed in June-July 2007 turns into an IR-1 in Dec. 08 and he gets out of the military in April 2009 then we need to have an idea of the timeline from the point of forwarding the I-130 from the USCIS to the NVC and then on to the Embassy. Is it going to take the average 10 months like I suspected. Is the CR-1/IR-1 really an average 10 months in Egypt from beinging of application to obtaining the visa? If we are stuck in an even longer wait because of the automatic switch to the IR-1 what is the other option then? I move to Egypt May 2009. Technically if I live there for 6 months I could file for the DCF. Is filing for the DCF after 6 months be a shorter process than the IR-1 will take? These are all the things cropping up because of the consider of the time it's already taken and the automatic switch to IR-1. We have just waited so long already. I'm also concerned is the application information that we submitted going to become outdated and we get an RFE for a request of new evidence which delays the process even longer.

Sometimes I feel like giving up on this whole thing because it may be four years of being married before he gets to come back with me to the US.

I also need to know these potentiel timeline pitfalls because I need to consider how long I may be in Egypt for. I am trying to keep my options open but I want to make the best use of our time possible. Life is what happens while you're busy making other plans.

Ran out of Edit time so here is the edited version:

I don't know why they told you to wait until Dec to change it. It does automatically change from the CR1 to the IR1 after your 2 year anniversary, but you have to watch them at the consulate, and remind them that he is eligible (at the interview) for the IR1. At one time they would change it from a K-3 to the CR1/IR1 if it got to the consulate before the interview, but I had heard that they don't don that any longer. They screwed up my husbands and gave him the CR1, and we had been told that they would fix it at the POE. The consulate told us it would take a couple of weeks to correct it, but we didn't trust them so we decided to correct it at the POE. At the POE they told him to go back to Morocco and fix it, so we decided to fix it here. It only took about 3 weeks after they got it, so no biggy, but less stressful to get it right the first time.

So then the next question would be, has the I-130 already been approved by the USCIS? If the answer is yes then anyone can tell you the timeline between the USCIS to the NVC. It took about 2 months after the approval to get it to the NVC in our case.

Once at the NVC then the next question would be, does the consulate you are going through process the entire CR1, or do they leave that up to the NVC? For Morocco they let the NVC do the processing and schedule the interview. The time ours took at the NVC was 4 months, and I believe that is about the same as it is now (corrections anyone?). So if Egypt is set up to let the NVC handle that then I would plan on about that amount of time. The NVC scheduled the interview about 6 weeks for later. This of course would definately be determined by your consulate. So what I am saying is that if your I-130 petition is already approved, and if they follow the same rules at the NVC, I would expect another 6 months to complete at the NVC, then add the average amount of time to schedule the interview for Egypt.

Of course, if they process them themselves this timeline is pretty useless. Wish I could give you more.

Thx! That is helpful. Both the I-130 and I-129 were approved at the USCIS Dec. 14th, 2007. The I-130 is just sitting at the USCIS until I request it to go on to the NVC. If they automatically change it then I need to explain this to my Husband anyways.

I also need to know what fees we're going to face going into this. I know it's larger fees for CR-1/IR-1 up front. I have read that the NVC now schedules the interview for Egypt since Feb. this year.
