Hi all...

sorry but i am so confused. I am getting conflicting information.

I have been told/read that after the NOA2, packet 3 will be sent to my fiance including form I134 which I as the US citizen need to fill out. Is this the case? the I864 is not until my fiance arrives in the US?

BUT....i am also being told/read that I 864 is needed when my fiance submits packet 3 to the French embassy?

I am trying to take care of these forms and send them to my fiance in France so that he has them in hand upon arrival of packet 3, but am so confused as to which form he actually needs?

HELP! which is needed and when?

I-134 is used for your SO's visit to the embassy.

I-864 is used when your SO adjusts status to permanent residency.

According the French Embassy page on this VJ website, the I864 is needed. This is why I am confused. All the feedback i am getting says otherwise. So I guess I am to assume that the website is wrong and all I should be concerned with prior to my fiance coming to the States via K1 visa is the I-134?

I suspect you're reading the website in the wrong context but it could just as easily be wrong. Often the confusion comes from reading information about "immigrant visas" when the K visas are non-immigrant visas, issued by immigrant visa units at US Consulates.

Facts are cheap...knowing how to use them is precious...

one possible solution when receiving conflicting information is to email the consulate/embassy where the interview will take place.

another possible solution is take both forms to the interview.

Ya know...now that you mention it... am running for more coffee.... :bonk: that's correct .. I-864 for AOS, I-134 for Embassy/Consulate. (However according to VJ's (France) Embassy section - the I-864 is part of Packet 3.)..

I-134 for the US embassy in Paris/ I-864 for AOS.

In the packet 3, it is asked for the I-864, but in my case, someone crossed out that, and wrote "I-134". I guess it is why it is wrote I-864 on the embassy info in VJ.

I know many other french persons who went with the I-134, and none of them had any problems.

It is not unusual for the consulate to make little or no distinction to the P3 for either visa type... and is undertandable when it comes from a consulate that probably issues more immigrant visas that "K" visas... They are simply programmed with I-864 on the brain...
