I-751 , wife is in moscow with daughter

I am sending in I-751 in the next few days, it includes my wifes daughter. They arrived in the US Septmber 2006 and we were married 3 weeks later. They both have Conditional green cards now.

My wife has been living with her daughter in Moscow while her daughter has been attending college there. We felt it was not very safe for her to be in Moscow alone. Her daughter completed 1 year at the Moscow university before they came to the US with K-1 and K-2 visas. Her daughter started in a college in the US but found it difficult to understand lectures and wasnt doing very well. They both went back in June 2007, My wife has been back and forth 6 times since then but her daughter has stayed. I have alot of evidence showing proof of on going marriage. Will the service center see that my wife has not been here by checking her A number? Should i attach a letter explaining why she has been living in Moscow with her daughter?

You said that she at least has come back and forth, but her daughter has been more than a year out of the US? did you file for her or she file a Reentry Permit? you need to file a reentry permit if you going to be outside the US for more than a year but less than two.

Your wife must sign the I-751, at the end is her application not yours even you are filing jointly.

And yes, you should put a cover letter explaining that why she stay so long outside the US. How old is her daughter? you said college?

Your problem will also be that she does not RESIDE in the US. And yes, they would know from passport stamps where she has been.

Her daughter is now 21 as of october 11. She is now in the process of applying for a SB-1 visa to re-enter the US. She did not plan on being out of the US for more than 1 year but her classes and final exams were extened into July of 2007 making her stay more than 1 year.

My wife did sign the I-751. She mailed it to me from Moscow.

I know they can look at the stamps on the passport but the VSC will not see my wifes passport, a copy of the passport is not included in the paperwork being sent. Do you think VSC will look to see where she has been by tracing her A #.

I will attach a letter explaining why my wife has been in moscow for a extended period, i think its best to tell everything
