Filling for a K1 (Need some advise)

Hi Everyone,

I needed some advice with filling a K1. I am a U.S. Citizen and will be getting married to an Indian girl in India in the month of January, 2009. I know that as I am getting married I should apply for a K3 visa, however can I apply for a K1 if I do not register my marriage and bring her to the U.S. and get married that way?

Do keep me posted on any suggestions as they will be very helpful.

The best advice anyone can give you is to seriously reconsider having this type of arrangement (non-registered marriage ceremony) and filing a K1/Fiancé visa. Can it/has-it been done successfully? Yes.

Is it advisable? No, not for most. :thumbs:

IF you are getting married in India, it's best to go with K3 and CR route. You can get engaged in India then have your wedding here in the states, even folks who have done engagement ceremony at times get into trouble with the Consulate office where they feel the pictures submitted looks like a wedding. Like the previous post said, is it possible yes, have others done it yes, but knowing all the facts, It's not legal, your case can get rejected, ban, so I wouldn't risk it.

Look also at the advantages of K3 and other options, once the person gets here with K1 you still have to do AOS, and the person can't travel until you get travel doc from AOS. With the other options the person gets the green card without having to go through Adjustment of status since they came on an immigrant visa.

what u want to do is like a catch 22 if u dont register the wedding and file for k1 they may think ur legally married ........ if u apply for marriage visa with out registering the marraige they will tell u ur not married i have seen both things happen on the forum since i have been on here better to avoid anything that looks like it could be a marraige........................

Can go either way as estadia has pointed out. Best to be very clear on how you want to do it. If you want to get married in India, then go for K3 or CR1 visa and if you are planning on getting married in the US, then go for a K1.
