I filed the I-601 in the USA a couple months ago in the USA. Does anyone knows what's the time processing for the I-601? What's the percentage rate of the I-601 in the USA? Does anyone ever filed the I-601 in the USA? If so please share your experiences with me. Please tell me anything you know about the filing of the I-601 in the USA. Entered the USA in July 1999 on B1/B2 (I-94 valid through January 2000)

High school from January 2000 to June 2002, played basketball (Graduated)

Applied for asylum in June 2000 by advise

IJ denied my asylum in September 2002 (Granted Voluntary Departure)

Appeal filed in October 2002 (BIA)

Married an US citizen in August 2003

oBad marriage (Arranged by my college basketball coach)

oLawyer lied about applying for marriage petitions, but actually never did.

Appeal dismissed in February 2004

Separated in June 2005

Divorced in July 2006

Death of a son in July 2006

Remarried in August 2006

Son born in September 2007

College from August 2003 to May 2008, played basketball (Graduated)

Filed in August 2008 and pending (I-130, I-485, I-601, I-765)

Thank you for your question. Yes my I-485 is pending for the same period of time because i filed all of them together. I rescheduled my bionetrics appointment for the I-485 and I-765 many times because i was told i can be arrested and deported if i go to it. Yes i have an attorney who told me to look for another one who deal with deportation case and stuuf...I'm so lost. Please let me know if you have any other questions or advices. Again thank you.

I'm not an expert, but my advice would be to get away from the lawyer you have, I would call Laurel Scott. She charges $125 (i think) for a consultation. Your timeline has so many things going on that I would hate to venture a guess on whether you will need, or may file a 601. What I do know is that you should not have sent one in already.

I was event told that it was the wrong way to go, that a motion to reopen was the best way to go for me. Yes my timeline is so mess up, i just want this over. Illegal presence is normally forgiven upon marriage to a US citizen. Waivers for unlawful presence are filed abroad, not in the US. Waivers are filed upon request by USCIS. If you never left the US after your overstay, you are not banned. The 3/10 year bar only comes into effect upon leaving the US. There should be no need for a waiver for unlawful presence as you married a US citizen and never left the country. Run away from that lawyer as fast as you can. Most will take your money even though they have no experience in the type of case that you have. As suggested above, Laurel Scott is an excellent choice, as is Heather Poole at humanrights attorney.com.

If you never left the US after your overstay, you are not banned. The 3/10 year bar only comes into effect upon leaving the US. I agree... I have struggled with the need of filing of a "waiver" from inside the USA in the first place... it is not typically what occurs...
