Question about I-864....

My husband has had a very irregular work history, therefor I will be relying on my MIL's income. I have understood that both my husband and my MIL file the I-864?

I was just going through this form, and I'm super confused.

Part 1 Basis for filling out affadavit of support. What do both my MIL and Hubby have to fill out for this question?? Like I said, we will be relyin on my MIL's income, so....

Part 5, question 21. Persons NOT sponsored in this affidavit How does he have to fill this on, and what does my mil have to write here? I will be the only one immigrating. So do they put zero's in all the boxes, and a one for our son and himself? And leave the spouse part open?

Like I said his work history has been very irregular, he has changed to many jobs, and was unemployed for a while, now he recently just started working, but he has not been paid yet. Right now he is in training and getting a regular income, once he starts working, he will be getting paid a server salary and will be paid on commission. So how can we calculate his annual income???? Just based on the training salary? Or should I just put that he is unemployed?

Thanks so much for your help! This form makes me want to hire a lawyer, Im so scared to fill out the wrong thing and get denied, unfortunately I cannot afford the fees of a lawyer.

They fill out separate I864s. So you'll submit 2 forms. Pick the first option in the forms.

It's about your household. For poverty guidelines you need to count everyone in your household and dependent children (whether they live with you or not). So put a 1 next to everyone in you household on your husbands form and add them up. On your mother in law's form put everyone in her house hold and the person immigrating (you) and add them up.

Get a job letter from his company, it should spell out everything and would be great since you don't have many w2s and his tax returns would be a little low.

What exactly is it supposed to spell out? An estimate of the annual income or the fact that he will get paid in tips?

You say, it's about household size, but why is the question "persons NOT sponsored in this affidavit", then it asks you, "if you are married, write 1." Well obviously we are married, but he will be sponsoring me (well his mom will). So what do I put in that box?

Plus the question above it asks the number of people you are sponsoring, it will only be me, so that is a one. Then at the bottom of that question, you are supposed to count the whole household (not counting anyone twice), so that would be a total of 3. But if I fill in a 1 for the spouse line, then it would be 4, which is incorrect. You see, what I'm saying? Why do they make it so complicated?!
