Timeline

I have a question. What if you are here on a K3 visa and you don't file for AOS withing the first 2 years you arrive???? or .....what happens if you file after your K3 visa expiration date????? reason im asking is my husbands AOS package was mailed back to us and we mailed it back and im not sure its going to get to USCIS before his visa expires!!!! Anyone got an answer for this??????

01/28/04-met online via yahoo (hot diggity!!!!)

spoke on online and cam every day for over a year

04/01/05-andy comes to tennessee for 2 weeks!!!!! (double hot diggity!!!!)

06/18/05-andy comes back to stay with me for 3 months!!!!!

12/30/05-andy comes back to stay with me for 3 more months!!!!!!!

03/18/06- WE GET MARRIED!!!!!!!!!!!!!!!!!!!!!!!!

***HERE STARTS OUR VISA JOURNEY***

04/03/06-mailed packet to texas

04/07/06-touched

04/08/06-check cashed @ texas

04/16/06- 1st NOA!!!!!!!!!!

05/10/06-mailed packet to chicago

05/12/06-touched

07/20/06-2nd NOA.!!!!!!!!!......took forever !!!!(had to send back additional info which was

some form saying youve never committed any horrible crimes!!!!!!

08/22/06-went for his medical!!!!!!!!!!

****waisted a bunch of time because we both recieved packets and got confused..he was sent

k3/ds papers and i was sent I-864 forms for cr-1....WE GOT MIXED UP!!!!!!!!!

10/03/06-hubby mailed off check list for k3 to embassy

10/12/06-hubby recieved interview date!!!!!!.............NOV 7th @ london embassy!!!!!!!!!!!!!!!OMG

11/07/06-APPROVED!!!!VISA GRANTED!!!! YAY!!!!!!!"

no problem... He still arrived on K-3 status... The underlying I-130 is still there waiting for the AOS application... all will be OK

Will he get deported???? im just really confused. someone told me that if you dont file for aos within two years of arriving then you will get deported

well... I suppose technically he could be subject to deportation... but the reality is that nobody will come a looking.... they can't find the xx million illegals that have been here for years let alone a poor slug who could be but a few days out of status...

File all your papers and you should be good. As long as he doesnt get into any trouble with the law, deportation is unlikely. Anyone who overstays can be deported but as mention it is unlikely especially if law abiding and married to a US citizen who is filing.

Immigration Journey

09/15/08- Married my Wife.

10/07/08- Sent out I-130, I-485, GR-325A, I-864, I-765, I-693 Evidence of Marriage.

10/09/08- Package arrives in Chicago.

10/16/08- Money Orders Cashed. $930, $80, $355

10/20/08- NOA Received for I-130, I-485, I-765

10/27/08- (I-130) -- TOUCHED

10/28/08- Received Biometric Appointment for 11/07/08

11/07/08- Completed Biometrics. 30mins in and out.

11/07/08- Both I-485 and I-765 touched. Looks like it was touched/updated due to biometrics.

11/24/08- Requested I-765 Expedite.

11/28/08- Received Interview date for 01/28/09 @12:30pm/ garden city, ny.

12/08/08- I-765 updated on USCIS. Ordered production of your new card. Think expedite worked.

12/18/08- EAD CARD RECEIVED (expires 12/12/09)

12/30/08- Applied for SS with EAD, Birth Certificate, Marriage License, Passport no i-94 or valid visa was needed.

1/28/09- Conditional Green card approved. Passport stamp I-551.

11/8/10- (I-751) Removal of conditions received in Vermont. $545.00 Sent

11/17/10- Received I-751 Receipt dated 11/9/10.

12/29/10- Recieved NOA for biometrics on 1/18/2011 , 1PM. Woodside, NY location.

spouses of USC may apply for naturalization in 3 years of arriving, correct? my husband will be coming on a CR1, thus giving him a 2 year GC. we are required to file for AOS within 2 years to receive the 10 year GC, however, what will happen if we wait for the 3rd year then apply for naturalization?

won't work, huh? the GC will have "expired" by then? i'm probably answering my own retarded question.. haha! :wacko:

NVC Timeline:

7/25 : Case # assigned

9/30 : Case completed!!!! (THANK YOU, LORD!!!)

10/03: Interview date assigned

US Embassy in Manila:

10/30 : Paid Document Verification (just to be on the safe side)

11/12 - 11/13 : Medical at SLEC

11/18: INTERVIEW DATE/MANILA EMBASSY/0630AM - VISA APPROVED!

11/20 : Visa in hand! (that was fast!)

11/30 : Flight to USA!

Life in America:

11/30 : POE:LAX

12/04 : SSN issued - 12/13: card received in the mail

12/04 : "Green Card" issued - 12/13: card received in the mail

NOVEMBER 30, 2010 : CR1 expires

You will not file for AOS as that is Adjustment of Status... You will file to Remove Conditions. A different form
