Hi All,

I applied for a I131 Reentry Permit. It took a while after I sent the application when the notice biometrics arrived. I understand taking the biometrics is necessary to proceed with my application for a i131 travel document. I have already left California/USA, since it would be easier for me to reschedule my biometrics appointment to a Application Support Center at the East-Coast not West Coast. (Currently staying in Europe)

I wrote an letter for an appointment request in Boston, but got an new appointment notice for California. So tried to call uscis under 1-800-375-5283 and was not able to reach an customer represeantive. Where do I have to call, to change that meeting. The ASC in California has also no phone number on therer webpage..

Could someone please help me?

Thanks,

gandolf

You have a major problem..

1.

Re-entry Permit

A.

If you are in the United States as a permanent resident or conditional permanent resident, you may apply for a re-entry permit. After filing your application for a re-entry permit, USCIS will inform you in writing when to go to your local Application Support Center (ASC) for your biometrics appointment. (See Biometric Services Requirement.)

You must be physically present in the United States when you file the Re-entry Permit application. However, a Re-entry Permit may be sent to a U.S. Embassy or consulate or Department of Homeland Security (DHS) office abroad for you to pick up, if you request it when you file your application.

Departure from the United States before a decision is made on an application for a Re-entry Permit usually does not affect the application.

However, where biometric collection is required and the applicant departs the United States before the biometrics are collected, the application may be denied.

You should not have left the US before getting the re-entry permit. I suggest you return to the USA before your 12 months is up.

So you are planning to out of the US for longer than 12 months?

Did you read the post about being denied if you leave the US before your biometrics are done? so you flying back to the US just to do the Biometrics is not going to work. You need to have them done before you leave. then the re-entry permit can be sent to a embassy in whatever country you are in.

You can not change the location of your biometrics unless you are changing your address in the US to that location. so if your address is on the west coast they are not going to change your Biometrics to a city on the east coast unless you live there.

You have screwed up my friend and you now have no choice but return to the US before your 12 months is up.

USCIS hotline does have reps you just have to hit numbers until you get one. Like others have said if you don't have a re-entry permit you have a SERIOUS problem. You should return ASAP and pray you don't get stopped at customs. If they do your green card may be taken away and you sent back to were you where.

Don't let the choices chose you, chose the choices that you want.

I think you should contact your US embassy/consulate about this. They might find a way for you to reenter the US without problems. Be prepared you might have to apply for a VISA again. (K3 perhaps). If they can't do anything for you, you should return to the US. The sooner the better. There you can try few things. Either be honest and be interogated at the airport or use the VWP. The last option is not preferable as you're not eligible for WVP and officers probably catch you.

First option worked for me. I was to reenter the country with expired J1 visa. I was eligible to stay in the US as I got a visa extension document. However, I didn't realize I should have gotten a new VISA for reentry. So at the point of entry I had to explain all this and the IO issued me a special waiver so I could enter the US without any consequences and resume my status. It had cost me about 260 dollars, though.

Anyway good luck and be careful next time
