applying for EAD before AOS...

Hi,

My fiance just arrived into the USA last week; as we get ready for the next part of this process, we have tons of questions so we've been reading the guides and posts....According to the guide, we understand she applies for the SSN, then we get marriage license, we get married and we apply for AOS; of course, everybody says to apply for the EAD when you apply for AOS to save the money and we wondered---can you apply for the EAD before the AOS (money is not an issue so the extra fee is irrelevant)? Is there any advantage to doing so?

Currently we are living in florida, but there is a strong possibility we will move to another state early in 2009 and thus we wondered if getting a head start on applying for the EAD is of any advantage than waiting for the AOS; the wedding date is for late nov so we are hoping to apply for AOS late December.

Also, from reading timelines---if we apply from Florida, then we move lets say to Washington State---would that delay the EAD processing time?

2009-01-12===> Sent AOS packet via UPS
2009-01-13===> AOS packet received
2009-01-28===> NOA's received in the mail
2009-02-01===> Biometric appt received in the mail
2009-02-06===> Completed biometric appt thru walk-in
2009-02-06===> Applied for expedited AP thru the phone
2009-02-14===> Received AP in the mail
2009-02-11===> Case transferred to CSC
2009-02-23===> EAD received
2009-05-02===> Green card received in the mail, no interview done.

Timeline

For a K-1, applying for EAD before AOS means filing unders category A6. If and when this EAD is approved, it will expire concurrently with the K-1's I-94 (90 days after entry). Considering that the EAD approval could take 60-90 days and costs $340... what benefit will you derive if you only have less than 30 days to use it (best case)? or without any validity period at all?

An EAD based on the K1 expires at the same time as the I-94. It will be expired before it arrives.

Aha! that's what we wanted to know, if there was any benefit at all, and apparently there is none! Thanks!
