2 quick questions, please help me out if you can!

1. i heard a rumor it's better to submit petitions (I-129F or I-130) in January because there are only a certain number of the k1 and k3 visas they give out "per year" so if you file it in january you have a better chance... does this have any truth to it at all, or all made up? is there one time of year that's better to submit than others?

2. during the 2.5 years we've been together, we spent 7.5 months together bike touring. although we weren't in ONE location, we were certainly LIVING TOGETHER. I'm wondering if we can both put that bike tour under the "residency during last 5 years" section of the G325a form as a way to communicate not only where we were at the time ("traveling throughout southamerica by bicycle) but also to show that we lived together for a long period of time. Though it's not technically a "residence" do you think it's acceptable/a good idea to put this bike tour on both of our G325a forms?

1. haven't heard that one, that's new to me!

2. The bike tour is great evidence of seeing each other in person and as part of your ongoing relationship. I don't think it qualifies as residency, however.

1. Thats not true, if it was I'm sure the USCIS will have posted, like they do with the other visas. Besides the sooner you apply the better no matter what, remember there's a lot of people who are sent REFs or have sent incomplete or wrong info, so their cases are delayed and the other ones are considered first.

2. You can put the bike thing in the space where you explain the circumstances how you met.

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

1) There are no annual quotas or limits imposed on "K" visas. If it were true then the best month to file would be about July so that the interview would occur in January (assuming a 6 mos processing timeline)... FWIW, petition approval is not a guarantee of a visa therefore not an allocation of an available visa either (which does not exist anyway).

Never ceases to amaze me the amount of mis information out there. It's a good thing you asked, eh? ;)

VJ is the best and most reliable source of information regarding this process you will find. This includes 'professionals' and immigration workers. ;)

The best time to file is right this very moment because it's very likely you will wait the same amount of time the rest of us have.

In your explanation of how you met and when you saw each other simply state the trip you took and note that you were together.

We had an 10 year relationship before we filed, travelled all over the world living together and seperately. We simply included a timeline that went along with our proof. They just want the facts and proof that you are a 'true' couple.

Excellent advice, except write a long, exhaustively detailed explanation, boldfacing and yellow-highlighting dates and routes and locations, and support this with photos. See below.

Yes -- include such a timeline, bolded and highlighted in accordance with the advice above. The bike tour is not residency, but proof of relationship. The Guayaquil consulate may not accept evidence that you try to bring to the interview, so definitely include this proof in your I-129F filing, along with absolutely everything else (e-mail logs, phone records, chat logs) that you can lay your hands on. Do not believe advice to the contrary from posters here who have not personally experienced the truly rogue Guayaquil consulate.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
