My girlfriend is in the U.S and we are talking about getting married and not sure which would be the quickest way or best way for us to be together via visa.I have read allot of information via the forums and i think i have a good idea on what it takes but not sure which visa type suits our situation best and am not sure if i may have gotten my wires crossed after all the reading i have done...lol.......

I currently am in Canada and was off work with a disability but will be attending college in Canada for the next year in order to get a new career for when i am settled in the U.S. .Unfortunately i will not be able to show means of support cause i was on disability pension and their for have decided that to be together the best way will be via marriage. My Girlfriend or soon to be wife has a good job and makes problay 3/4x the poverty rule so that would not come in affect.

Now am wondering which option would be best for us....not sure if i am correct on these please bear with me as am trying to figure this all out.

K1- Would mean we could hold off marriage for a bit.

Need to provide employment records and work history (due to my years on diasabilty pension, may not be a option)

longer process.

K3- Wife can be sponsor and no need to provide employment records or work or financial history.

Faster application process.

Would have to wait for SSN and update visa status before being able to work and is a little more costly of process.

-IR-1 / CR-1 - Wife can be sponsor and no need to provide employment records or work or financial history.

Seems it may take a little longer for approval.

You can move and start work right away once accepted.

Firstly who is US citizen and who is NOT? US Citizen must be able to support prospective immigrant when they com to the US.

Also is your girlfriend a US Citizen??

From your timing it soulds like marriage Now and the file for a CR-1 immigrant visa may be your best option, CR-1 tends to take about 1 year or so to get, it has a validity of 6 months after you get it, and ALLOWS you to WORK upon entry, K-3 Visa DOES NOT ALLOW work for at least 90 days after entry.

Hubby and I did a K1. In this case it is the responsibility of the US citizen to provide proof of income that meets or exceeds 125% of the poverty guideline.

Since I did K1, I'm not sure of the requirement for K3 and IR-1/CR-1 but believe it is the US who must provide proof of income. I am not sure if the immigrant can contribute to meeting the 125%.

My girlfriend is the US Citizen and employed in the U.S. and i am a Canadian Citizen.

K-1 requires a marriage in the first 90 days according to the link.also requires a EAD which takes about 90 days?

CR-1 immigrant seems the better way to go,some say is faster then the K-3 is that correct?

Are their allot of differences in the costs of the different visa's?

CR-1 tends to take a bit longer due to additional processing at NVC, but yes it is the best visa if you wish to start looking for work as soon as you arrive in the USA, K-3 CANNOT, and K-1 tends to be the same about work auth.

K-1 is "work auth" primarily to be able to get a SSN, some states are sticky about SSN requirement in order to marry. Most POE DO NOT stamp the visa with EAD stamp, so it can be a hard time convincing an employer that you can work without proof of EAD, and K-1 is only work auth for the 90 days after entry, so if an employer considers you they may not higher a person who will only loose work auth shortly after.
