Hello Friends

I am very new here ,and very much worried about my legal status as Permanent Resident(Conditional).i am here so may be some friend give me an idea.cmae to USA on K1 got married applied for I 485 got C G C and marriage did not work out got divorced (divorce filed by spous) . this all happend within few months .did not stay married even one year. Now i am worried, would they approve my I 751 or not . If someone has got any idea or suggestion for me ,i would appreciate that

You can file I-751 as soon as divorce is final, and waiver the joint filing requirement, HOWEVER you will need to demonstrate that the marriage was entered in good faith.

I agree with YuAndDan. If the marriage was entered in good faith, this should not be an issue. Essentially, you are removing the conditions by yourself w/o your spouse because you are divorced. My suggestion would be to work with an immigration attorney. I would imagine your supporting documents should include jt. acct statements, taxes, etc. Anything that shows you were a married couple. You may need letters from friends who know you/both of you and can vouch for you.

9/11/2008 – mailed I-129F

9/12/2008 – Received at VSC/NOA 1 sent (mail stamp-9/16)

9/15/2008 – check cashed

9/19/2008 –Received NOA1

12/28/2008 – Received NOA2 Approval email from CRIS

01/06/2009 – Left NVC for Mumbai Consulate

01/07/2009 – Received NVC confirmation letter in the mail

01/08/2009 – Mumbai Consulate received file electronically and sent packet 3 (info from DOS)

01/10/2009 – Mumbai Consulate received file (hard copy) from NVC (DHL tracking)

01/19/2009 – Overnighted packet 3 (still did not receive receive pkt 3 from Mumbai)

01/20/2009 – Packet 3 arrives at Mumbai Consulate

01/23/2009 – called DOS and was informed that packet 4 has been sent and interview date set.

01/24/2009 – Received hard copy of packet 3 (postmark Jan 20). Too late. Already sent packet 3 on Jan 19.

02/02/09 – Received Packet 4

02/04/09 – Submitted documents at the VFS Kolkata Office

02/06/09 - Medicals completed

03/02/2009 – BIG DAY, i.e., Interview Date

03/03/2009 - Visa received in mail

04/09/2009 - POE

AOS

04/17/2009 - CIVIL

6/16/2009 - Mailed AOS package

6/19/2009 - NOA1

7/08/2009 - AOS transferred to CSC

7/17/2009 - Biometrics appointment, EAD case Touched

8/05/2009 - EAD card production ordered, AP approved !!!!

08/27/2011 - Mailed ROC packageCIVIL

09/19/2011 - Early Bio (scheduled date 10/03/2011)

Timeline

You have to wait for the divorce degree. Once you got it fill up the I751 form and attach all kind of evidence including bank statments, credit cards' copies, utility bills, Lease shows both name, Copy of your DL/ID to show the same address and send to them. If the marriage was real, you don't need to worry. Try to demonstrate the divorce was not your mistake if they asked you to attend an interview. Don't wast time, collect evidence as much you can. and keep in mind that theres a 99% chance that you will get called for an interview and i would suggest that you come with an attorney. As everyone stated, it all comes down to what type of documentation you can produce as a proof of bona fide marriage while you guys were married. Everything that contains both of your names, pictures, affidavits. It does not matter that she was the one filed for divorce. Ive seen/worked on many cases like yours, Do not panic, as this is normal, people get divorced all the time! . You should include a personal affidavit explaining the circumstances. Once divorce decree is in your hands you can submit everything but be prepared to be called to an interview, so you have time to gather everything. Dont worry that you dont have everything when you submit your i751, you can produce the remaining paperwork later.

2004: I-485 Filed

2005: Interview & Conditional GC recv'd

05/2007: I-751 sent to TSC

06/2007: FP completed

05/25/2008: Recv'd letter that interview for 05/08 is being cancelled though I never recv'd a letter that interview was scheduled

06/2008: Cond'l GC 1yr extension expires 07/08, via info pass received a stamp in passport for another year

07/2008: recv'd interview notice for beginning of Aug

08/06/2008: I-751 interview and GC Apprv'l

08/20/2008: Physical GC Recv'd

05/2012: Eligible For Citizenship

Thanx you all my friends here on visa journey , i really appreciate your help and encouragment . i am preparing refrence letters about my case from my friends and will apply soon .i think i will have to apply as it is because we did not have things together ,only a bank account but nothing ,i look forward more good ideas and suggestions from all of you friends ,thanx again
