I just read INA section 212(a)(5)(A) and this does not seem like it would be related to your case unless your husband filed for an employment-based visa.

This particular section is specific to employment based immigration and the exclusion of immigrants in the second and third employment-based preference categories, and their ineligibility due to the lack of an approved labor certification.

Do you have a copy of the actual letter your husband received after his interview? How this type of refusal could be related to a family-based petition and visa application doesn't make sense to me in the slightest.

If this is correct, and what this letter says, I would be contacting every senator/congressman available to find out why my husband is being denied a family-based visa under an employment-based ineligibility. I would also be contacting the State Department directly.

I have taken a look at her form, and sure enough they marked the 212(a), and it states that it is to be sent back with the recommendation to revoke. My guess is that they marked it wrong, but it appears that she is having trouble getting a representative to assist her.

Well I am having a problem getting anyone to help me. I have decided to go back to Jordan, just not sure when. I work 6 days a week and I need to pay someone every day I dont work! I have no retirement, medical, blah blah blah. I am between a rock and a hard place right now. Contacted one lawyer said 2,500 and 500 to sue. Sue for what???/ He says to sue is the only way to get results. Congressmens office I talk to a Melissa who last told me nobody answers her from Amman and she would hang up and call USCIS directly.....never replied to me. Honestly ladies I DONT KNOW WHAT TO DO. So I take it sending everything to the Congressmens office and Senator is a waste of time now????? Wednesday I am planning to send off for a name change on my passport, I was not prepared to be going back to Jordan. I have asthma problems in Winter and the dread is horrible. Give me some advice, I have been sick over there once. Since being married I am taking blood pressure medication. My doctor has been very helpful trying to get me through this time until my husband could get here to help me. We live on an Indian Reservation and I am a Native, everyone knows everyone. I hate flying and had to take meds not to have a panic attack!! This is not good. Just point me in the right direction and I will do as best as I can. Yes it was for a CR1.

Who ever the lawyer you went to is an idiot. The consulate is a part of the department of state, and they can not be sued. As for the congressman's liason, at this point it won't do any good to contact the USCIS because they don't have it yet. The only answer they will give her is that the petition was approved. The key is the consulate right now, make sure it is them she is contacting not the embassy. Is she sending an email? They will respond, as Kiya stated, so that is the best way to get across. They usually respond within 2 or 3 weeks. If the petition does go back it will go by diplomatic pouch, and they can provide a number so it can be tracked. One it reaches the service center then it will do no good to contact the consulate.

I can't help you with your health issues, but if you can just go and spend some time with him it would be helpful for you both to get yourselfs together and prepared for this.

And as for the lawyer Kiya is talking about, I highly recommend him. He understand returned petitions inside and out, not many immigration lawyers do.

Oh Lisa. M4E and Kiyah sound like they have given you good advise and have some expertise in this.

Do you have a nebulizer that you can take with you? Also, I dont know what inhaler you used, but I stocked up in Irbid on Cipla, its like 2 bucks and is great compared to albuterol. Its salbutamol (the albuterol of the rest of the world).

Maybe you can go for only a week, since it sounds like you dont have any vacation time. Im so sorry that you guys are suffering. I hope you can work out a way to make a trip.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

The only time I need one is when I am sick in my chest. Normally I dont need it, Winter time is the worst. This week I will be sending in my passport to have a new one issued with my new last name. I am also sending in one for my daughter because I am hoping to be able to take her, she is 10. This is hard on all of us. I am thinking to not take college courses next semester and concentrate on my marriage. We are both willing to wait as long as it takes, but never expected this at all. So salbutamol is as good as albuterol or better? I have allergies also and took shots until they kicked me off because I had a red itchy face and sounded like a frog. The allergies can cause asthma. The worst things for me are mold and dust mites. I appreciate your input......you gals do not even know what it means to me. THANKS SO MUCH

I was thinking of allergies too. mold is the WORST for mine also. Have you tried just taking claritin? And yes, salbutamol is just as good as albuterol. edit-- if you get the salbutamol in JO, get the cipla, not the generic blue brand...it has some additive that made my breathing a little worse. The cipla is only like 50 piasters more than the other. :)

That would be so great to take your daughter too. I would put school off also, if I was you; to relieve some stress and save money. One semester in the grand scheme of things isnt going to do much harm.

have you tried flonase for allergies? Worked like a CHARM for me as far as allergies go...(I'm allergic to dust mites, certain trees, cats, dogs, etc) Claritin, Allegra, etc never worked as well as Flonase for me. :) They have generic now also so if you are strapped for cash or don't have insurance you can get it cheap!

well i finished this semester of school today! yipee! One less thing to think about. I have gained some weight and my sugar level was up today. I have to concentrate on losing a few pounds now. I was wondering if anyone has any idea what i can do about the drinking water in jordan? I mean i got a nasty kidney infection there and i only drnk bottled water, and lots of it. I am thinking to take a britta water filter. Should I boil the water first? someone told me to try purchasing only water from maybe Germany? I want to see my husband but being sick in Jordan is the pits. actually i took claratin and allegry and zyrtec a few years ago, but not lately. I do use the flonaise nasal spray. i recently got a new prescription for allegra but never tried it yet. Thanks for the input, I appreciate it.
