Heya, it's the Magpie =D.

Knight's still studying at the moment so he doesn't have a full time job -- he still has another year or so left in his degree. I know the I-134 doesn't specify a fiance has to sign the form, so as he still has support from his mom, can she fill it in instead?

:: Before-AOS Timeline ::

2009-06-16: Received SSN

2009-06-18: Got my degree classification! Got a 2:1 =D.

2009-07-04: Got MARRIED on Independance Day in San Antonio!

:: AOS Timeline ::

2009-08-06: Mailed off our AOS packet!

2009-08-10: USCIS received packet, no NOA1 yet

2009-08-14: NOA1, eeee!

2009-09-08: Walk-in biometrics, all done!

2009-09-15: Got AP, woo + driving permit

2009-09-25: Approved for EAD, waiting for card

2009-09-30: EAD in hand :D

2009-10-16: Received interview letter for 20th October :D

2009-10-20: AOS APPROVED!

2009-10-30: Green card in hand! Weeeeeee!

As the petitioner for you he has to fill one out and send any relevant supporting documents. If he didn't file a tax return because he didn't earn enough money, then he needs to say why he didn't file in a letter. "I did not file income tax in 2007 because I was a student and my income of $xxxx fell short of the amount required for filing."

And because his I-134 falls short of $$, then his mother fills out one too as the co-sponsor. She also needs to show some supporting documents like income tax return or transcipts, pay stubs, letter from employer...at least two things that support her statement of income.

If you download and read the instruction pages for the I-864, it answers alot of questions. It's another Affidavit of Support for AOS, but it gives a good explanation of questions you might have about support, co-sponsors, how big is family size, etc.

Also, don't forget that if you interview in 2009, then they will be looking for 2008 income tax returns from his Mum, especially after April 15, the filing deadline. Lately we have all talked about copies of our 2007 taxes, but we will be rolling into a new year perhaps before your interview.
