F1 gets AP - WHAT DO I DO????

I am an F1 student. I have been out of school for financial reasons my sponor died. I got married 3 yrs ago to a US citizen and still remained on an F1 visa. Now my husband and I just filed my papers. I got my ED card and Advance Parole. My visa stamp expired but my I-20 and I-94 have not expired. I would like to visit my country. Question: While I am there do I extend my student visa or the AP should allow me back in the country even though my visa expired last year. What visa do I enter the country with? I am confused!!

Are you in school now?

If you have been out of school as you say, your F-1 was probably no longer valid and you were out of status. With that in mind, travel with an AP would be risky, since it's not a guarantee that you'd be admitted. I'd hold off traveling until you get the GC. You may also benefit from a consultation with an immigration attorney since your case does not seem very straightforward.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

If your previous F-1 visa was expired.......don't leave!

From my understanding, even if you have advance parole, when you try to get back into the country, they will see that your previous F-1 visa has expired, and that you overstayed. There is the possibility that you will not be let back into the country.

Under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, aliens who depart the United States after being unlawfully present in the United States for certain periods can be barred from admission, even if they have obtained Advance Parole. Those aliens who have been unlawfully present in the United States for more than 180 days but less than one year are inadmissible for three years; those who have been unlawfully present for a year or more are inadmissible for 10 years.

There is a lot of info like that one on the web. I advise you to read and research it. If your previous F-1 visa was expired last year...then it HAS been more than 180 days, in which case, you may be penalized.

Be very careful with this

I advise you to wait for any traveling at this point, due to your circumstances, until you have received your green card as that last reply stated....or until you learn otherwise.

June 12, 2006 Noa1

Sept 7, 2006 Noa2 I-130 approved

Oct 10 ,2006 Received fee bill from NVC

Nov 13 ,2006 Received Packet 2 DS-230

Jan 4, 2007 Mailed Packet 2 to NVC

Jan 22, 2007 RFE from NVC aaarrrrgggghhh!!!!!!!!

Feb 28, 2007 NVC received "checklist" response and original documents for the RFE

March 13, 2007 Case completed at NVC! Whoooohoooo!! Ankara, here we come!!!!

March 15, 2007 Case fowarded to Ankara Embassy

April 4, 2007 Interview. Wife gets handed the little green paper. Not good. Need to submit a few more things.

April 9, 2007 Items mailed back to Embassy. Crossing fingers, rubbing the "rabbit's foot", etc,..that this may FINALLY be the end.

April 14, 2007 Visa delivered! Wife is finally going to be on her way back home!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

April 20, 2007 Wife enters through JFK. The days of grabbing my dinners at the WalMart deli....are now officially over!!!
