Helping an in-law immigrate (maybe off topic)

Hi All,

To some of the older members: sorry for staying away so long. I have been lurking a bit. To the newbies: take a deep breath, you will survive the process. We got a blue sheet and made it work.

I am looking at trying to help/bring a brother-in-law to the states. I have two stores and want to have him come and work with me. If it helps I can make him a part owner of the business ( corp. name: anh map, inc.) :lol: beforehand. Anyone have any thoughts / experience?

Looking to go back to VN next year. Linh is really wanting to see her family and I am "jonesing" too.

I think this is a wrong thing to do. I'm not an immigration law expert, but i feel that this is circumventing immigration laws. Unless your brother inlaw is an "out-of-this-world" store manager or no one in the US and do that that job except your brother inlaw, I think it's just wrong.

It would be very unlikely that you could get him a work visa unless you can prove that there is nobody else in the USA that is qualified to do the job. a family based visa would be your most likely route and your wife would need to be a citizen to file for him. the wait time for a sibling is many many years. so itsa not going to happen any time soon. you are looking at 20 + years.

To What's Next's point: it's not cirumventing the law. It's following the law. Don't be so quick to make assumptions and throw stones.

I am looking for people's experience in doing it the proper way if it can be done. Having a family member as a business partner is more preferable for me. Being that my stores are quick service restaurants the skills needed aren't specialized. And to immigrate based on investing/creating a new business the capital is much greater than is needed / available in our case.

I don't really see where it's possible for him to come based on work/business, but that's the beauty of VJ, there are lots of folks with lots of experiences to pool together. It certainly can't be as daunting as the K-1 process.

I didn't mean to cast the first stone. maybe i misunderstood you. When you said maybe you could make him a part owner is what threw me off. I took this as, he is not part owner now, but if making him part owner on paper would get him a visa, you would make him part owner. You have to consider that circumventing.

But if you are going to make him a true part owner, i think he should be elig for a business visa. he would have stake in the company's sucess and the right to visit up on his business. I'm not sure what the time limitations are on these, but i guess he can apply for extentions and stay here indefinately.

The process will take 8 to 9 years, he's in the F4 category, take a number and join the end of the line..........

The sooner you apply ($350), the sooner he'll arrive = at least year 2016 :-)

It's going to be an interesting journey for this. I've got to do more research about this. Putting his ownership stake on paper now is easy enough, just Fed Ex the papers. I don't want to do that without him here just for the logistics of needing a signature for normal needs.

Oh well. Still has to be easier than the fiance visa process. And we survived that one. :)
