just wondering, i and my fiance already have an 8 year old daughter between us. do we still need to prove relationship. does the two year requirement still apply?

You must bring proof of an ongoing relationship to the interview. Unless you bring paternity testing results (and this is in some type of layman's language), how would they know this is his child? All this means is that you met 8 years ago even if you did bring testing results. You have to show you've met at least once in the last 2 years.

There was an instance where someone was wanting to petition their high school sweetheart who they hadn't seen in years and their attorney stated they had to have met "again" within the last 2 years preceeding the application.

thanks for the info. His name is on her birth cert, because of health reasons, traveling has been limited.

Doesn't matter. You must fufill the basic requirements of the K1, one of which is having met within the last 2 years. You don't meet any conditions for not having to meet. You will need evidence of that meeting. Luckily, the child and all communication regarding that child should help to establish a continued relationship at the interview.

If the child were less than two years old...it'd be pretty hard to beat that as proof of having met in person (although you'd still have to supply some proof of travel, i.e., passport stamps, airline ticket stubs, etc). As we all know though, having a baby in today's world doesn't necessarily mean (or prove) a relationship.

Short answer is; No, you must [still] satisfy the burden of proof that you've met each other, in person, within the past two years :thumbs:

Thanks for the information, we found a dialysis center willing to take him on, so he will be traveling to ireland next month.

U guys have been a great help. ZB might want to stay in Ireland instead. Direct filing might then be the way to go. Not sure yet.

I'm sorry to hear about your fiances health issues. So glad you found a dialysis centre to take him on! Having him stay in Ireland, establish residency, marry,and do DCF might be an excellent idea.
