Hello,

I am kind of confused right now. Mu HUSbad applied for a K-3 petition ANd filed i-130 and i-129f and both got approved at the same time. Were sent to the NVC and I got a notice from the NVC regarding my i-129f that the case has been forwarded to the country where my marriege took place. I also got a letter from the NVC about the approved i-130 petition asking me to send them an affidavit of Support fee and they will contact me further about the affidavit of support form. Is my I-130 sent to the overseas embassy as well ? or is it still at the NVC ? I am not sure which one i should go with. I want my husband soon. But i am confused about what to do at this point of time. can anyone please give me a suggestion to what i should do ? and onbe thing more i also reccevd the packet 3.5.what shold i do?

and shuold i send from I-134 with my douemnet now or could i sent it later?//

At this time! CR-1s are MUCH, MUCH better visas than the K3.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I-130 only gets forwarded after AOS fee, and Visa bill is paid, and DS-230 is sent back to NVC along with other requested documents.

It is optional to pay the AOS fee and keep the I-130 moving, if you do pay the fees the I-130 may catch up to the K-3, and the K-3 gets dropped for the CR-1 visa. If you intend on just the K-3, then dont bother paying the AOS fee.

CR-1 has the big benefit of GREEN-CARD upon entry, NO ADJUSTMENT OF STATUS. K-3 CANNOT get SSN, WORK, or Get driver's license until they have EAD or Green-card, EAD can take 90 days or MORE to get.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I an stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

my k3 case copleted and transfer to US consulate and i recd packet 3.5..

and my I-130 approved and Assign me a number but case is nit copleted they want affdavit and support and furhter documents ..

hi.

you have 2 options.

first option, k3 route.

the nvc will forward your case to the embassy. the embassy will send you a letter.

i-134 will be used by you during the interview. it will be amongst the documents that you will present to the consul. (which will be listed on the letter from the embassy)

second option, cr1/ir1 route.

your husband needs to pay/submit the i-864 to the nvc, then submit the rest of the requirements to nvc (which would include the packet which will be sent by nvc to you).

note:

some couples opted to pursue both routes, k3 and cr1, and just waited which case will reach the embassy first (of course k3 will most likely make it first)

however, there have been reports that when a k3 is forwarded to the embassy the cr1 case is put on hold. (there have been conflicting accounts on that.)

but, if you dont mind waiting a few more months, i highly recommend taking the cr1 route instead.

the only plus side for k3 is that you'd be together sooner. but then, you have to adjust your status when you reach the states or file for work permit too get your sss. and believe me, without sss, you wont get anywhere (hard to get bank account, etc etc. )

actaully i m waiting for my vis more than three years and now i m furstrated thats why i need fasterway.... i now I130 easier but in paksitan its not faster.... and now iunderstabd ur answer thx very mnuch again,,,

and actually my embassy need all my original documnets throgh approved courier service..

Hey MISS Fatima,

Your question looks exactly same like the post I made couple of days ago. No worries, :) we are in the same boat. It's okay. Same concern with me. I don't know which route to choose. Looks like CR-1 is better, but it'll take forever i guess. I was wondering if my husband gets here on a k-3 when will he be able to work. I heard it takes 3 months to get a Work permit when you have already filed for a AOS. anyone got any idea.

Hi sis , well seeeing ur message i think u r married n u filed both fiance n as apouse n got approved for both so if i were u i would stick with k130 spouse case since i been stuck with i129F fiance case i filed they never give u visa then i been also waiting past three yrs now i refiled k130 for my hubby so my advice will b stay with ur k3 case .Best of luck
