Hey guys I want to ask you, when you are applying for the I-131, do you need evidence or documention on why you are requesting this document that is what I am confused about the most. I am pretty sure in my mind that I wont be approved for this document because I am now out of staus currently, so I am not planning on applying for it and plus I am have no intentions to use it for any reason, because its totally risky to use, so I want to know everyones experience on this question.

If you have overstayed, then don't even bother to apply for the AP. You are correct that it is too risky to use.

Plus, why overload the system with something you won't use?

Hey cdn_in_wa thank you very much for the info, yeah that is what I thought, I was pretty reluctant in applying for the AP because of my

current staus and yeah I have been told it is way to risky to use because if I was to try to travel to Toronto and tried to enter back into the

US my chances of being allowed back in are very low and my case would be abanonded so thanks for the info and will not apply for it.

I have AP and have used it. I had not incurred any overstay. The first time I used it, I was given a very hard time on reentry. I almost didn't use it again.

They questioned me extensively on dates and intent. I really wasn't sure I was going to be let back in the US. Other times I have used it since then have been much less strenuous. Still, I decided to stay put in the US once I had my interview date.

You are wise to forgo the AP and wait out your AOS.

Oh ok and wow that sucks you were given a hard time having AP and trying to enter back into the US. I want to ask you, what is your

timeline and what status did you come into the US and what stage are you in immigration journey? Thanks for the compliment and if you

dont mind me asking what part of Canada are you from and how long did it take you to receive your AP and EAD?

I am from Vancouver. If you click on My Timeline to the left side of my posts, you can find it.

I entered as a visitor and filed concurrent I-130 & I-485. We just had our interview on the 17th. We were told we were being approved by the IO, but it was pending review of someone else. Seems that is what most have been told in the Seattle office lately.

The POE that gave me the hard time was one of the local land crossings.

Forgot to answer about the AP/EAD. I didn't apply for EAD until August and only then because I wanted an SSN before the end of the year and I hadn't heard anything about my interview. So that's still in process, although I'm hoping the GC gets approved before they bother with the EAD.

I got the AP in a same day application through INFOPASS after several calls and gathering the appropriate information. I had an immediate family member in ICU, had to get a letter from the DR and some other documentation.
