Hello! My friend is US Citizen is going to bring her brother to USA. My friend marital status is legally separated and she has a documented paper verification from the lawyer. She has a question about the part 6 of the appplication I-130 - "Marital status". There are only 4 options - married. single, widowed and divorce. She is confuse and wanted to know what she needs to do in her case - separated. Is this belongs to married or divorce. Please advise and thank you all for your inputs. Take care.

Then check "Married", Separated is NOT divorced, and NOT free-to marry. A person that is separated is still married to their spouse.

Is now a US Citizen immigration completed Jan 12, 2012.
