Calling the legally knowledgeable...I don't know why I didn't think about this before. But wouldn't a student visa to study English followed by a marriage in the States be a quick shortcut around all of this nonsense??? I have in fact taught plenty of students in the past who easily got visas to study in the States. She applies for one of these non-degree English programs and gets a visa in a couple of months. (We have the means to make this happen.) While here, we get married, and do an end-around around the ABSURDITY of the constantly changing time frames of the G. Anybody see a reason that wouldn't work?

It would definately be a shortcut. But, visa fraud if that is your plan.

It's one of the confusing quirks that is US immigration. If you meet someone while they are on a student visa or a previous acquaintance comes over on a student visa and while here you make the decision to marry and file directly for AOS, that's ok. If however you have made the decision to marry and get them here by filing for a student visa, that is fraud. It is all about intent and what can be proven at the AOS interview. You may be able to do that and get away with it, but the much safer and legal route is filing for a fiance or spousal visa.

My SO and I were going to do this route (started the student thing prior to our engagement, though), but it's hairy. Your SO will have to prove she can support herself financially for the year and have strong ties to home in order to even qualify for the visa. You're talking tuition+living expenses, and to get a student visa, it will more than likely HAVE to be a degree program. They'll ask her a ton of questions about why she wants to study in the USA instead of her home country, and so on. Ours fell through because he didn't have the money to prove he could support himself with out of state tuition costs.

Not to mention, you have to apply in advance to get a student visa (get accepted into the program, and it can take months to get your student visa approved).

I don't think this is as much of a shortcut as you think. And then there's the whole visa fraud problem. If they realize that, you've got a ban to worry about.

Sorry for the bummer news.

Yes it could definitely be done, but what you are talking about is called committing visa fraud and if caught your fiance will most likely be banned from the US FOREVER.

I would LISTEN to Aubry, They were going to do this route AND already did the research. We had also thought OF this but things like lying came into the pot because we could not tell how we REALLY met and how long ago and all that.

If your love is strong then waiting that 6 months to 8 months time is WORTH IT. I would rather be able to say HEY we have been together this long to them then lie about it all.

Also Aubry is right they will ask HEAPS of questions and sometimes to get the student visa it can take about as long sometimes as the K1 visa...SOOOOO Stick to the K1

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Integrity always trumps expediency. Just because people apparently 'get away with it' sometimes does not mean they are free from the consequences of their choices. Every major faith has the believe that our current actions will have consequences that extend beyond our immediate lives. I am in concordance with those who say that the wait is worth the value of honesty.

People slip across America's border every single day, and some have even turned a blind eye toward it. This does not justify the argument that it's ok to do. I am proud to be working hard as an American, and to be able to even have the opportunity to bring my fiancee here is a privilege. With mitigating circumstances, I understand full well that the process may be prolonged, however I do accept that.

One's circumstances in life are largely out of one's immediate control. Yet how one chooses to respond to all situations is entirely a matter of person decision. I do not bemoan this process a moment. Speak to me in 5 months, 9 months and 5 years from now, and I can confidently state I won't then either.

Patience is a valuable ally.

we also thought about having perviz come for medical meeting or something and he could have easily but we decided to do it the right way yep we have been waiting a ridicules long time compared to others but im still glad we did it the right way up to usa if they allow us or not i hope they do but so far not even noa2 but at least we dont have any guilt over the way we did it and ruin it for someone else that wants to come for medical meetings that is a doctor from a third world country.

What you are proposing is visa fraud.

In my case we applied for a K-1 and had NO problems with the consulate in Guangzhou.

Is now a US Citizen immigration completed Jan 12, 2012.
