CWR is correct - you are not a legal resident yet (that's why you still need an AP to travel and an EAD to work) - you are adjusting status and that's why you are not illegal (Your K1 expired the day you entered USA.) And your permenet residency count doesn't begin till you are approved (so it doesn't matter how long you had to wait for it - your clock begins once you are approved not when you filed, not when you got married.) Well...the K-1, from how I understand it, does NOT expire the day you enter the US. You have 90 days before the K-1 is invalid, which is the timeframe in which the marriage is to occur, and upon that marriage the K-1 expires.

The K-1 visa is good for one entry. Once used, it is nothing anymore. The i-94 (admission slip) is valid for 90 days for K-1 entrants. During that 90 days, K-1 entrants must marry their USC petitioner (and ideally apply to adjust status).

You are under a "period of stay authorized by the United States Attorney General." this is due to being an Adjustment Applicant who is awaiting a decision regarding an adjustment of status application. This is a perod of stay or grace, called a tolling period. Thus you are 'Lawful Alien' waiting to adjust to a conditional or permanent resident.

About getting a credit card, I think we only need to have a Bank Account and SS#, because I already have 3 credit cards, even though I did not get EAD yet. Of course, it depends on the credit card company policy,though.

I remember someone being cautioned by a mutual acquaintance of ours when someone made such a statement a while back. The K1 visa may have some 'residual value' should the visa holder have to leave the country prior to marriage and the end of the 90-day stay.

Good point. I concede the K-1 visa could have a life beyond the POE.

if i remember correctly, when i applied for my credit cards.. i put immigrant in it... and i got it just fine..

and if they dont have the "immigrant" choice.. hmm.. i dont remember what i put..

but actually i believe we are Legal resident because we entered the US (K-1) with the permission to get in to the country. and the AOS is for a Perminant resident.. so either way. it's still legal resident... that's my opinion.
