Hi ... just found this place tonight ... a friend told me about it earlier this week and I thought I'd check it out. Seems like a lot of knowledgeable people here.

I had a question about the I129 form. Part C, question #2 ... have you ever been convicted of any of these things ...

My story, real quick. 8 years ago, going through a terrible divorce, I was charged with several counts of domestic violence. What happened was she had gotten a restraining order on me, but it hadn't gotten served to me. During this time I wrote several emails telling her I loved her and wanted to make things work. Turns out, she was having an affair and was using the trumped up order to get our daughter away from me ...

Anyway, there are lot's of details I'm leaving out ... so please don't judge me. The "charges" came from me writing and calling her during the restraining order. The court understood the D.A. was trying to make an 'example' out of me, saw through everything and gave me a deferred sentence. I did some community work, classes, etc ... and the case was eventually dismissed.

In light of the fact that I was never actually "Convicted" ... how should I answer this question on the I129?

Thoughts?
