I-765 Rejection# 2

I got the first rejection for the I-765 (EAD) document because we used an older version of the I-765 (no major differences, but understood it was our fault).

Round #2, we get another rejection for the same reason "the applicaiton/petition was filed on an outdated version of this form." I don't think the person even looked at it because the form we used was the correct version (Rev 05 27 08 N). Maybe they got confused because we included the previous rejection document, but c'mon this shows how little they attention was paid to this document (pretty sad considering what we paid for everything).

Now I don't know what to do - send it in a third time and hope the same person doesn't reject it again.

I will call the USCIS helpline on Monday and hope they have some more information, but I won't hold my breath.

I would refile the form, highlighting the form number and putting a sticky note next to it saying 'THIS IS THE CORRECT FORM AND WAS PRINTED DIRECTLY FROM USCIS WEBSITE", then include a cover letter detailing the same information. Staple (yes, I know they don't like staples but that means they will pay attention) the two rejection notices to the back of the form. If there has been a more recent form posted, however, then fill that one out and submit it instead. Good luck.

do you think USCIS scanned the I-765 form and automatically showing that the form was expired ( there's a barcode below the form) ? I don't get it...the expiration date of this form was on 08/31/08 ..but it's newer version 05/27/08....what if a person downloaded a form before the expiration date..and some got it after the expiration date...do you think there should be a pro and con?

I would recommend calling and try to get someone to help you. We ran into an error on my wife's AOS application and re-sending it would have resulted in another rejection. My post is listed below:

why not make an infopass and see them in person, show them these rejection letters and explain, people on the phone are worthless and just read the script...

If something like that happens, do you have to pay AGAIN to refile it?
