Hi All

My wife overstayed her 6 month USA tourist visa by 5 years (arrived in 2001). She voluntarily returned to Brazil, its been 2 years now. We married in Oct 2008 in Brazil. I live in USA and am US citizen.

We will be filing I-130 and G325A next week. We are not sure if we should file a I 129F for a K3 visa. Will the K3 be helpful, speed any process? Is getting a green card quicker or longer? And are we looking at the waiver process?

We enjoy reading this site, you people are great with your help and advice.

you might want to Consult with a lawyer, not sure how to answer but you might have issues down the road with the overstay....And yes you will need Waivers but not sure in what level.... check this out http://www.visajourney.com/forums/index.php?showtopic=319

11.25.08 - POE (JFK then SFO)

11.26.08 - Visa Journey is Over!! TOOK 737 DAYS....Habibi is Home!! :) :)

12.10.08 - Applied for SS Card

12.15.08 - Welcome Letter Received

12.17.08 - SS Card Received

12.26.08 - Green Card Received :)

Timeline

Five year overstay gets a 10 year ban. She will need the I-601 waiver. For the 601 you will have to prove that it would cause you, the USC, Extreme Hardship for her not to be allowed to join you. You will file the 601 at or after the interview when they initially deny the visa. A REALLY good website for information on the 601 is www.immigrate2us.net

Two good attorneys for this type of waiver are at:

www.humanrightsattorney.com

Immigration law is federal, so you can use an attorney from any state, but you need one that is VERY EXPERIENCED with the waiver process if you decide to use one.

As for the k3, they are processing at about the same speed as the 130's right now and if you enter on a k3 you have to adjust status in the U.S. which adds an extra $1100 to the process. . .I'd just go with the I-130 if I were you. .

not to be the bearer of bad news but unfortunately the waiver will cause more waiting time. most waivers are taking 12 to 18 months to process and cost $545 or 601 and $545 for 212.. sorry but wanted to let you know... best wishes

09/2005 submitted I130, 08/09/2006 completed medical,case left NVC to Montreal Embassy July 7, 2006
06/07/2006 NVC CASE COMPLETE! (278 days from I130 submitted to NVC case complete)
August 2006 Interview at Montreal Embassy, need to submit I601 & I212 waiver.July 2007 submitted waivers to Montreal Embassy who forwarded to Vermont Service Center
October 2007 rec'd receipt and notification or waiver processing from VSC, April 2008 rec'd RFE for I601 July 2008 submitted RFE, and rec'd receipt, advised written decision within 60 days
October 24, 2008 sent written request for case status to VSC, May 2009 after written request for status update recd letter "being processed"
July2009 requested Senator inquiry again.. response "with officer, required extra processing" if no response check back 6 months!
Dec 09 requested senator inquiry again, Jan 8 2010 requested more than "general inquiry" senator Jan 11, 2010 Senator requested supervisor
Jan 12, VSC told senator's office we wld recd notice in mail 7 - 10 days Jan 20, 2010 I601 DENIED.... letter dated Jan 14, 2010
April 2010, granted 290b approval to send to Appeal for review

October 2011 Appeal denied due to fraud, now dumped by husband, now with Canadian Arabic woman from Tunisa for Canada residence.. processing Immigration with her now

thru Canada

July2013 He ws deported back to Egypt almost a year ago due to out of status for almost 2 years

Actually Brazil seems to be taking about six months to process waivers.

Agreed. 6 or 7 months has been what they are taking through Lima, who adjudicates Rio waivers.

waiting-Unfortunately for you, Vermont is actually about the only adjudicator that is taking that long right now.

08/12/08 - Mailed application to CSC (I-485/I-765/I-130)

08/14/08 - CSC received application (confirmed via online signature)

08/21/08 - Notice date by USCIS

08/25/08 - Received NOA1

08/29/08 - Notice of Rejection of 797C Fee (Sent in extra money - money order mailed back.)

Fee waived for I-765 application when filed concurrently with I-130 and I-485.

08/30/08 - Biometrics Apt Notice received

09/13/08 - Biometrics completed and picture taken

11/05/08 - EAD card production ordered

11/07/08 - Received I-485 Interview letter

11/10/08 - EAD card production ordered (again)

11/13/08 - EAD approval notice sent

11/14/08 - EAD arrived in the mail

11/21/08 - I-130 touched and I-485 finally shows up online

12/08/08 - Interview for GC - RFE requested :-(

01/02/09 - Response from RFE received (Form G-56/Call-in Notice Appointment)

01/16/09 - Second Appointment to review application -- APPROVED! :-))) YAY!!!

I am not too familiar with K-3 visa. I would recommend you contact an attorney before doing anything. Not sure how the marriage in Brazil would count here.
