I-485 REF - Please help!

Hello there.

So far my experience with this whole K-1 process and now AOS process have been all good; up until today.

I received a REF saying that I did not fill out the I-485 properly, and off course they did not put what was missing in there. Now I am worried about it.

My questions are:

What is my USCIS status? - My K-1 accordingly to the I-94 was expired on Aug 21, 2008 am I still considered a K-1 status??? Or am I something else. In my mind I am nothing right now - just married to a USC. Please help.

Next question under "list your present husband/wife, kids..."

Should I list my husband, and is he then applying with me or not??? A bit confused here. He is a USC and does not have a A#... Please help.

Appreciate quick answers!! I am scared...

In my mind I am nothing right now - just married to a USC. Please help. You are simply "Out of Status" - once your AOS process has begun, you'll be "Pending Status."

Next question under "list your present husband/wife, kids..."

Should I list my husband, and is he then applying with me or not??? A bit confused here. He is a USC and does not have a A#... Please help. The Example form CLICK HERE is very useful and should answer your questions directly.

An I-485 is the alien's application. Fill it out as if the USC is not involved in the application per se, other than providing the I-864.

your status would be AOS pending

yes, you should list your husband but he's not applying with you. under the A#, write NONE since he is a USC

An I-485 is the alien's application. Fill it out as if the USC is not involved in the application per se, other than providing the I-864.

Just to clarify - the USC spouse is to be listed on the I-485, there is a tic-box to select if they are applying with you or not (which if they are a USC, they're not applying with you). :thumbs:

If you are referring to Part 3, A. ="In what status did you last enter" you entered at a K-1 Visa Holder.

Part 3. B.= You list your Husband. And there is a box that you will check that says "Applying with you" check NO

OCTOBER 22 2008 (DAY 170)- I-765:Card Production Ordered/I-131: Approval notice sent

OCTOBER 27 2008 (Day 175)- AP Received

OCTOBER 30 2008 (Day 178)- EAD Approval Notice Sent OCTOBER 31 2008 (Day 179)- EAD Received

NOVEMBER 4 2008- Applied for SSN / NOVEMBER 24 2008- SSN Received

JANUARY 15 2009- INTERVIEW-APPROVED!!

JANUARY 31 2009- GC RECEIVED_No more USCIS for 10 Months[/color]

I'm a fraid that I'm missing something in my I-485 too...The only question that I wanna ask is...Page 1 I-485 Part 1..asking for "expires on.".. I'm canadian, When I flew here in USA, they did not issue me a I-94. The form asked for I-94 and I wrote N/A for Canadian Visitor, however it asked again about "expires on"? I don't know what to write...can I write expires on: 180 days from my arrival date...do you have any suggestion? that would be big help..anybody pls...

or N/A as you do not have an I-94

I didnt get an I-94 either and I just put N/A Canadian Citizen in both
