Question on fees / timing

Hi,

My K3 is in process and I just received the package from the NVC for the I130 asking for the AOS fee. I'm thinking I want to move forward with both to see if my case gets through NVC relatively quickly and the interview date is not that far from the K3 interview date then that would be good. Question I have is once I pay the $70 for the AOS fee, I'm assuming the $400 fee is coming up next relatively quickly and I'm not sure if I'll be in a good position to make a determination by the time it's due. Any advice? Guessing if I pay the $400, and then our interview date for the K3 comes up then it's like I wasted the $400 for nothing?

If your case is complete at NVC and the paperwork reaches the consulate before your K3 interview, you can request the officer during your interview to give you a CR visa instead. If, however, you feel that the paperwork may not reach the consulate before interview, you can e-mail NVC and also talk to supervisor to expedite sending your paperwork to consulate in hope to reach before the K3 interview. If you pay $400 but then decide to go with K3 visa, you have "wasted" $400. Also, if you know that you are definately going K3 route, you can stop the process at NVC by not paying $400. That way, you do not continue your CR1 petition at NVC. Others can confirm/correct this.
