I have just got my interview date for July 11th and have a question about required documentation.

It says to bring an I-864 and evidence if not already submitted. When I submitted the application in March it did not have 2005 tax returns for either my wife or co-sponsor.

It says nothing on the letter about bringing a new form with another years information but I have seen people on these forms taking another I-864 to their interview.

Now I know that the best thing is to be on the safe side and just do another one, this is fine for my wife but I would rather not have to bother my co-sponsor to fill in yet more forms for me. I'm sure it wouldnt be a problem but they have already done a lot.

My wife makes significantly more then the poverty level and we only have the co-sponsor because she has only had the job for 6 months following finishing her post grad.

What I'm looking for is the experiences of people that have and have not taken new I-864's and the thoughts of other people on this?

Well, I have my interview tomorrow and my husband makes enough now so

all I'm taking is:

- my sponsor's 2005 taxes

- my husband's and my taxes - 2005

- new affidavit notarized (my husband)

so no new affidavit from the sponsor, didn't want to bother him either.

October 30, 2005 - Married in Vegas

December 27, 2005 - EAD, AP, AOS mailed

January 4, 2006 - received in Chicago

January 27, 2006 - RFE for medical received

February 13, 2006 - Medical received

February 15, 2006 - Biometrics appointment at 10 am

March 1, 2006 - AP touched

March 4, 2006 - AP received

March 8, 2006 - EAD received

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Feb 28, 2008 - will be sending removal of conditions docs.

Well, I have my interview tomorrow and my husband makes enough now so

My interview is also on July 11th. we submitted our application on March, also before the 2005 tax returns were available.

I'm planning on having my husband fill out another I864 (we didn't need a co-sponsor in the first place) but will have him sign it in front of the immigration officer.

Am I correct on assuming that it doesn't need to be notarized if he signs it during the interview?

I'm just surprised you have your AOS interview, we're going through Boston too but it says they are only processing I485's from Dec 2005.

Looks like you guys are either really lucky, or Boston has just jumped ahead.

Good Luck on the interview and be sure to post your experiences. I don't know of too many going through Boston and would really appreciate any insight you gather from your interview.

As for your question, I can't comment as I am not as far as you guys, but good luck still!

Looks like you guys are either really lucky, or Boston has just jumped ahead.

Surprised me too. I think our RFE must have really slowed down our processing.

As for the I-864, I would definitely bring 2005 taxes to the interview. I am surprised you weren't RFE'd for them as you submitted after we did. I'm sure they'll want to see those.

I'll be sure to post detailed information for my experiences at the Boston interview to help those that will be going after me.

Taking my wifes 2005 tax returns really isnt a problem, id just rather not have to hassle my co-sponsor again.

As i said before we werent even sure we needed a co-sponsor as my wife makes enough money but has only been doing so for 6 months. Tough call I know so if anyone has any experience of this in Boston or anywhere else that would be great

Ian,

Does your wife have a Joint Sponsor because you thought you'd need one or because the USCIS told you that you needed one?

By all means bring your wife's 2005 tax return and updated evidence of current employment and income, including an updated letter from the employer that's as positive as possible about her status and expected future with the organization. You may find that the interviewing officer will return the proposed Joint Sponsor's I-864 to you as unnecessary.

The reason we have a joint sponsor at all is that until Nov 2005 my wife was a student. She finished her post grad and started work in Nov 2005.

While her salary is over the poverty guidelines and it is a secure job her tax returns for 2002/2003/2004 showed very little income.

When we were submitting the original packet we were trying to find out if it would be OK that she had pretty much nothing to show on the 3 years of tax returns or if it would be rejected. The concencus to this question was maybe maybe not and there was no way we would be able to tell. As such we got a co-sponsor just to be on the safe side - the USCIS never told us that we needed one (but they never told us that we didnt).

I can't say that your wife will not need a Joint Sponsor, but she may well not. Her current income is more than adequate, you say that her job is secure (try to provide evidence of that), and there is a perfectly good reason why her prior years' income was insufficient (a reason that lends support to the notion that her current income is sustainable).
