We got the reply from the senator: we are stuck in background checks. USCIS' answer has such scary beginning phrases that my heart stopped for a moment when I started to read: "The processing of this case has been delayed. A check of our records establishes that this case is not yet ready for a decision...." , then it goes on with the background checks and to get back to them in 6 months if we don't hear from them until then.

That's it for us, nothing else to do than wait. I'm curious how long it will take, hope not 6 months :)

Oh wow! 6 more months?? blimey! hopefully it wont be long!! well at least you got an answer as to what is going on. tho it doesnt make much sense!

I just sent office the letter to my senator and i cant wait to get some sort of word. I'll probly get the same one.

urgh!! how depressing.I'm so sorry to hear this. I hope its a comfort to know that you're not alone. I'm sure it won't take another 6 months. They just say that to cover their ####!

6 more months??? Because of background checks? Is the petitioner serving in the military or another government role requiring a Security clearance? If not, than they are full of #######.

How far away does the petitioner live from the CSC, maybe you should request an INFOPASS appointment at the closet Immigration field office, to talk about the status of your case with a live person.

well if they started the security checks in October, when they received our RFE reply, it's been already 3 months - I try to be positive :)

as long as we have the visa in June, I don't care how much longer we are stuck in security.

PB&JAM As far as I could see, you get the response from senator/congressman pretty quickly, good luck and keep us updated.

ndalessandro, my fiance is not serving the military but for the government -do you really think this would slow down the process and get us stuck in security? And it's not him, it's me working for a sort of governmental institution...I thought that it's maybe because I live in another country than my home country and thus they have to check in 2 places and furthermore I visited the States so I have a visa record...

Hmmm, as far as I know... and I could be wrong when I say this... but the first part of the fiance visa process, is the petitioner submitting a 129F petition for fiance visa.

The USCIS than does background checks on the petitioner essentially to make sure the petitioner is who they say they are. To make sure they are not a criminal. To make sure they are not a sexual pervert who will use his foreign wife for porno or sell her into sex slavery. To make sure the petitioner and beneficiary have met, to be sure this isn't a case of fraud.

The foreign fiancee really isn't a factor in the first part of the process. The foreign fiancee will have to essentially do the same thing during the 2nd half of the process, when the petition is sent to the foreign consulate/embassy. Which is why the foreign fiance has to provide police certifications and other documents required by the embassy, to prove they are who they say they are, to prove they are not a criminal ect ect.

Again, maybe I am wrong.. but this is to date, what I have read from numerous people at VJ.com and in various locations on the internet.

But, i would definitely try to schedule an appointment with an immigration officer and request to have a 'detailed' explanation of what 'background' checks means. Remember, someone paid the government $455 for a service to be provided (not counting taxpayer money to budget the USCIS), and damnit, they need to provide service.

The foreign fiancee really isn't a factor in the first part of the process. thats exactly what i thought! they are looking at me the American petitioner, correct? I'm as clean as a slate. I dont get it :(

now am a little bet more confuse , and you now what NICK is rigth, they dont do this process for free, so the USC have all right to ask and got some info, i dont Know why ppl is afraid to Goverment process????? i think 6 months more, and want to cry and run, all this ####### is nonsense!!

Jokalu, did u or your SO send in your letters to congress (or senators)? (thanks for your help by the way). I just sent mine in. Hopefully hear something soon! i'LL be very happy to see a touch on my case. I want to see my last updated date change for once! :wacko:

Maybe it wouldnt be so hard if we knew what on earth was going on with our cases. Wish I could be a fly on the wall there. Or a fly on my file. haha, my file is probly hazardous to flies, its covered in dust and spiderwebs. :P

hmmm i have been told a couple of times on here that the service center checks the intended immigrant, nvc checks the petitioner and then at the embassy stage the immigrant is again checked thur different resources than he or she was checked when it was at the service center if their name receives a hit all of this mess just confuses me lol

i think im not sure but i think they check to see if there has been any other visa petition for that person, as well as if their name is close to any terrorist just stuff like that seems kind of dumb i been waiten this long if thats all they check lol so im sure there is more to it than i know perviz also has a goverment job but he is a doctor at the hospital so i dont know if that is why he is longer in the process or something csc concocted up in their little mines i think they hire from the zoo to fill their employment needs lol

Hmm, Zulya is a lawyer for the government. As far as visas, the only visa she has had is a B1 Tourist visa she used to visit me in October 2008. No overstay, no violations, ect ect.

Meh, I'm sure all is okay. And if USCIS wants to be dicks and play the waiting game, maybe I'll move to russia.

Yes, my fiance send the letters the last week, one for each Senator (Burris & Durbin) , and one for his congressman, so we just wait for a response, and ill be very very happy to see a touch or anything in mi case too, but am afraid to hear that we are finally in a background check, my SO has become a USC the last year, so the USCIS check his entire life a few months ago, so what is the problem, and about me, i dont have police records, i never entry to the USA, we send a plenty evidence of our relationship, we have a two years old son, so why they put our file under all the petitions????? i dont get it :crying::crying::crying: , but you know what, am sure you have your NOA2 before me....

aww, you guys have a son? thats more sad that he cant be with both his parents. i doubt i'll get mine before you...but I still am hoping we get ours the same day!! :star: :star: hang in there! =)

Nick I understood that it's the beneficiary who gets checked at this stage. My fiance, the petitioner, got his citizenship one month before we applied for the visa, so he had been already checked up.

Still I don't get what's the connection with a job in the government. This made me think at the second time when I visited the States and when the customs officer got suspicious that I was coming back so soon (first visit in October, second in December) and she started to ask me all sorts of questions, among which: where I was working." Is it a government?" I don't know if my positive answer made she go into more details (my job, etc) or she would have asked me for details no matter the place of work….

I think that I met my fiancé at the right moment, one year before he became a citizen, otherwise it would have meant more painful waiting for the right to be with him. It is so very strange not to be able to be with your SO when YOU want but only when THEY want. Let's rule people's life!
