Does the immigration will difinitely deny my AOS application because I'm still employed in canada?

Do you think the immigration will delay the process of my application or difinitely deny my AOS due to my current employment in Canada? I entered here in US as a visitor to visit my fiance but end up getting married. I quit my job in research but not in private home care. Do you think this would be a problem and will affect my AOS papers to delay? Do you think would be better to put none in question # 15 found in Form I-130? What should I do?

well as long as you can prove that you didn't really intend to marry when get here then nothing to worry;just tell the consul that you decided to get married since when you're here,you don't want to leave your "love" anymore or whatever is the real story....and as long as you can supported by the petitioner (above the poverty line guideline)and have pictures of you to provide,evidence of a genuine relationship,then nothing to worry about..

Considering the fact that you're applying for AOS in the US, and you're not allowed to leave while that's processing, the fact that you don't have a job anymore in your home country is a moot point.

I don't get it....you mean it's better for me to quit that job? Do you think having a job back there will rise an argument? or you mean.....it doesn't really matter....? You said " the fact that you don't have a job anymore in your home country is a moot point"..you mean it's not relevant point?

Hi there! What he/she is trying to say is that since you will Adjusting Status from within the US you once you file the paperwork you will not be able to just leave the US at will. (You will have to wait for the appropriate documents). If you are unable to leave the US while your case is being processed then you will not be able to work in Canada if your physical presence is required for the job.

Thank you so much...it doesn't really matter if I work there in Canada..they don't really care..the reason for keeping this job just in case if immigration will question my entry here in US...but it doesn't really matter whether I'll keep this job or quit this job right? HOw baout the process...do you think this will delay my AOS application and I-130?

No, it shouldn't matter. Just mention it on the I-485, but don't volunteer the information at the interview, unless asked, in which case explain that your physical presence was not required for the job in Canada, they were willing to grant you leave of absence. I can definitely understand that you wanted to be on the safe side and have a job in case you had to return to Canada.

Hmm, it shouldn't but if I were I would just consult with an attorney to be sure. Just an FYI they are starting to get a bit tighter with Canadians who jump the border (So to speak) and adjust status from within. I heard this from 2 Immigration officers yesterday.

So I would suggest consult an attorney and read ALL the guides before starting. I know for a fact you CANNOT work in the US AT ALL without proper authorization. I know I saw on here that someone was working for a Canadian company here in the states, which might be your option (Although I don't know what the outcome of that was).

I quit my job in research after coming here in US. I called my lab supervisor that I'm quiting my job because I'm getting married and decided to stay with my wife....I entered in US on July 19 and I'm still employed in research and 26 of july I told my supervisor that I'm not able to come back to my work....then...I received a record of employment from Service Canada stating there that I quit my job on july 25.

Yes, we understand that you quit your job in research in Canada, so that should not be an issue from the standpoint of Steph's concerns. However, you mentioned you still have another job - private home care. Care to elaborate? - is this here in the US, in Canada, is this with an employer with a contract? Are you a registered nurse? If not, it sounds like you were taking care of some people in their private home and getting paid for it as a means to make some extra cash besides your main job in research. If you do not have an official contract for this, then I wouldn't even worry about mentioning it.

We live in a global society... many people have the opportunity to work remotely.... besides... if it was or could be classified as unauthorized work, this is typically "forgiven" as a courtesy to the USC spouse.....

The private home care is in Canada, I don't have a contract with this employer....Yes that's right I had 2 jobs back in Canada..but working in this provate home care just only my part time job so that I can earn extra money while I'm working in the research.....besides this is my job since I'm studying in high school until I've finished my college.

If you do not have an official contract for this, then I wouldn't even worry about mentioning it.

I am confused. How can you be here in the US and filling for AOS from a tourist and still be employed in canada, how do you get to work every day? If you are here in the US but are not attending work then you need to resign from that job too. you can use the resignation letter as proof that you still had a job to return too before you got married and decided to remain and file for AOS.
