Filing for k1 but just lost my job

I was just about to start the process but lost my job, I will be getting unemployment, should i still file? or will it be rejected? What should i do?? Im worried it will take to long to find another job, and i feel its wasting time that the forms could be filed, if they check my bank account its still ok? Do they actually call your employer to verify??

Well, if you haven't filed your application yet, you cannot clame that you have the job you're mentioning on your fincancial support form. So, you have to revise your paperwork. I would recommend you to wait filing till you have found either a new job or sponsor(s) who can sponsor the applicant. If you already have sponsor(s) meeting the income requirement, you can eliminate your share. That is I think the only way that allows you to send immidiately.

If you are just filing the I-129f you are 6 mos. or more from having to provide financial information... hopefully you will be back on your feet before then.

FWIW, they do not call employers or check account balances independantly from any information you provide

Can someone else file for her to come here on a k1 for me?? Like my family etc?

Only you can file an I-129F... Only your fiancee can apply for a K-1.... If the consulate accepts co-sponsors then the I-134 can be provided by other qualified individuals

Nobody can apply for a visa for her other than the alien (A USC does not need a visa to enter the USA) ... You are petitioning for determination of eligibility for a fiance(e) visa. How could your family petition for her... Is she there fiance(e)? Have any of your family memebers met her face to face in the last two years?

Since she can only marry and adjust status to/with the petitioner, I suppose you could have a family member petition, but then you would have to allow her to marry your family member. Outcome would not be what you wanted then....

I'm just trying to find a way to get her here, by any means necessary. Even though i am now jobless, i down own my home , will they take any of this into account?

Coming out of the PI there are not that many means possible..... Assets can be considered.....

Will you be working 6 mos. from now? If so, send in the I-129F... you got at least 6 mos. to worry about and resolve this... If you don't have it solved then all you have risked is the processing fee?

If you do not have a job or other means of support... how are you gonna survive let alone take on the responsibility for someone else, who will not be immediately able to work...

I spoke with an immigration lawyer who said i should fly back, get married and then return, then i can have a co sponsor even if i have no income, so that might be the best option, once i return i can look for a job

Only if you petition and she applies for an (CR/IR-1) immigrant visa... if you petition and she applies for a K-3 spousal visa you will be in the same boat....

If it were me, I would wait till I was back on my feet with a job. Its hard enough to support yourself let alone be responsible for someone else. And that someone else would be unemployed when they arrived as well. So if you think you can be back on your feet and employed by the time you need to fill in your aff. of support then file. As you can see from peoples timelines on here, it certainly doesn't happen over night. We all know how you feel about not wanting to be away from your loved one but starting out financially unstable, in my opinion, isn't a great starting point for your new life together in the US. Again, just my opinion. Good luck to you in whatever your decision is.

If you can't sponsor her, then a family member should co-sponsor. You won't need to provide that information anyway, until your petition for her visa is approved. Then, she will be applying for the actual visa in the Phils. That could be 4-6 months from now.

You are the only one who can petition on her behalf. But you don't need to be the sponsor.
