Forgive me if this is repeating a previous post - but I noticed recently that the US changed TN visas to last for three years.

Given that the TN visa is not dual-intent, do people think this will make it easier to marry an American while on a TN visa and then apply for a green card? I've been worrying about the timing of renewing my TN and then immediately getting engaged (worried that it would look like I lied on my TN application). But I figure this is good news, since it's hard to know what your intent will be two years after getting your TN.

Anyone have any thoughts?

My BIL was on a TN visa for several years (now a PR) - this would have been nice for them!

As for thoughts on how a CO will look at your engagement with a TN visa of 3 years vs 1 year... it would seem like it would look 'better' I suppose.

I received a new TN Oct/08 in Toronto and it was only for one year. I asked about the three year length and they it was still a one year limit. Any ideas?

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

No, it doesn't matter what your status is when you get married, it matters about filing for AOS right afterwards. You will be on processed the same as everyone else, including those that just came to the US on vacation and got married in a local court for instance. There is no special treatment or speedy service for anyone on TN status or any of the H1 visas or any other visa or work status at all.

Get a new TN, get married, file AOS. Simple as that. As you can see in my timeline I had 6 months (applied by mail in June for my new TN and got approved, though was still on my current one till Nov). This meant if my AOS didn't come in in time, I was set for a year and a half with a valid work status as it was appoved before I got married which is perfectly legal.

The INS doesn't care what your previous status is when applying for AOS. At your interview all they will care about is how valid your marriage is. They also pardon quite a lot of things as well (illegal immigrants getting married etc). All of you will be in the same processing time...

Jan - 10 year Green Card accepted

Mar - 10 year Green Card arrived

Oct - Filed N-400 for Naturalization

Nov - Biometrics done

Nov - Just recieved Naturalization Interview date for Jan.

2007

Jan - Naturalization Interview Completed

Feb - Oath Letter recieved

Feb - Oath Ceremony

Feb 21 - Finally a US CITIZEN (yay)

A 3-year TN-1 would have been nice for me in 1997-1999 when I was in "hurry-up-and-wait" mode with an approved I-140 but unable to go to next stage due to a chop#### attorney's misfiling of my labour-cert application as EB-3.

That aside: a TN-1 who marries a USC should still file almost immediately I-130 and full-package (including EAD and AP) AOS.

(no, I did not marry a USC at anytime, though this was suggested in a quarter-c0cked way in November 1998 by my mum)

2006/08/23 AP and EAD approved. Two down, 1.5 to go

2006/10/13 Pras' I-485 interview--APPROVED!

They hadn't enacted it yet in October I don't think.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
