Help with K-3?

Hello,

Let me give you a brief explanation first.

July 2007 I sent I-485, I-130 I-131 & I-765 for my wife's case. On July 1st 2008, we received the noticed that the case was denied because we travel outside the country without showing the I-131, so they say we abandon the case and also because we use a non-immigrant visa (B-1 Visitor Visa) and you need a immigrant visa in our case K-3. So after that I when to the USCIS to see what was the next step and they told me that I need to fill the I-129F (K-3) and send a copy of my approved I-130 to the addres from where I get the I-130. I have already 3 month waiting the respond that they receipt the paper but nothing yet.

So my question here is...

Is the above address correct to send the I-129F or I need to use another one? That was the address from where I received teh I-130.

Do I need to apply for an I-130 again and send the I-129F after I received the receive notice from the USCIS?

04-27-09 - Trying to switch k3 interview for CR-1/IR-1

04-28-09 - Sent E-mail directly to the Chief of Visa Operations in DR requesting the switch

05-06-09 - NVC received a request from Embassy requesting the file

05-07-09 - Medical Exam

05-08-09 - Left NVC

05-12-09 - Received Consulate

05-19-09 - Interview Date: APPROVED!!!!

05-27-09 - POE (JFK, New York)

Well, it's confusing. You say the USCIS denied the case, meaning the I-485 and I-130 together I assume, becasue you used the B-1 visa to re-enter the US. If that is the case, then you just have your I-129F floating in nowhere land and it will most likely be denied since the I-130 was denied a while back.

The best thing is for you to call or make an infopass appointment with the USCIS and find out exactly what is going on and what are the steps you need to take. If you're filing for an immigrant visa, make sure your wife doesn't overstay her visitor's visa or she may be subject to a ban from entering the US.

Are you desiring for her to adjust her status to resident (greencard) from inside the USA without a trip back home for a visa interview? If you are I think you have a huge problem on the horizon....
