For those of you who remember (particularly Meauxna), I was the one who was married on July 1, 2002, had my AOS interview on December 23, 2004 and due to screw ups (fingerprinting not done right) and basically being put on the back burner for 18 months, I then received my conditional card dated July 7, 2004. Ok so I went back into the local office and told them they must have made a mistake. I should be getting a 10 year card based on being given approval after my 2nd wedding anniversary. The Supervisor went through the spiel about how there is nothing in black and white stating that I have to be given a 10 year card and until it clearly states it in the law, they will continue to issue the 2 year card no matter the length of marriage. Their lawyer says they were within their right to do so.

So on April 23, 2006 I sent paperwork into Nebraska to have conditions removed. It was all sent back to me today (minus Acclo fastener) and paperwork all mixed up with the following letter:

The Nebraska Serice Center is returning your Form I-751 and any supporting documents. If the date of marriage indicated on your I-751 Part 3 is correct, you have have been improperly classified as a Conditional Resident upon entry or adjustment and that this filing would then not be required. You will need to bring this letter to your local office for review of your classification. If it is determined that you are not subject to the conditional residency requirement, your local office will process a new Permanent Resident Card with the correct classification at that time.

Ok so now I have to make an appointment and hopefully get this cleared up locally. Does anyone know if this letter will take precedent over what the local office told me above?

Did they at least return your payment, too, or are you expected to pay for that again? :wacko:

After the screw-ups you've endured, only to have received all that back and the accompanying letter...tell me, what were your first thoughts? :whistle:

I hope you get it all sorted soon (F) ....sometimes I think I have seen it all, but someone always proves me wrong!

Everything was returned - passport photos and cheque. My first thought about it all was - here we go again! Like I mentioned above "It never fails". I just hope I don't have any hassle with the Boise office over this.

Nebraska has never caused me any hassle, it's been our local office.

PMSL, M. Now we know what happens! You should post this over at BE--I would be interested to see Folinskyinla's take on this new development. You were the first, but by no means the last, to have this happen. Everyone was given the same advice--- I wonder what will happen to the people who were given 10 year cards when it should've been 2 year.. they were told to go ahead and file I-751 at the right time.

Only one more year and you can apply for Naturalization and then you will be COMPLETELY rid of USCIS forever!!!!! What a nice thought!!!!
