Hello,

Looking for some help!

I am a US citizen and married my Italian gal (Italian citizen) in Denmark, where she lives (and I now visit). Her status, and mine, was tourist at the time of our marriage (August 2008). She is and has been a resident in Denmark for many years BUT, at the time of marriage we were both tourists.

She has a rejected Visa from the US Embassy in Denmark (she had applied previously for a 6 month Visitor Visa.)

FIRST, wondering if she can clear up the rejected visa or simply travel to to the USA on the Visa Waiver Program.

Does the rejected visa affect the Visa Waiver Program?

Perhaps, needing to change her residence back to Italy?

Next, shall we apply for a marriage visa?

AND, which method of getting her to the USA as a US citizen is best?

(She also has an 11 year old son)

being married to her already rules out the k1 fiance(e) visa. you will need to get a k3 or i think they are cr-1or ir1 visas have you read the guides above they are very helpful

i think the son requires a k3 visa, i'm not sure f there are other varients of this like the spousal visa :unsure:

Your suggestion to read the guides was a good one. The rest is just misleading. When you don't know about something, there's no need to speculate. Others will be along to help.

Since you're married, your choices are CR1 or K3 for your wife and CR2 and K4 for your son. As suggested, start with the guides and then return to one of the spouse visa forums with remaining questions. This is the K1 fiance(e) visa forum. You don't have a fiancee.

Facts are cheap...knowing how to use them is precious...
